I made the same mistake as Kim in California and thought I would save money buy listing with a discount broker. He saw me throw BuyOwner out of my house and thought it was funny. I fired BuyOwner because of cheap directional signage and no one returning phone calls. Rick Kopp did the same thing I had to buy my own OPEN HOUSE signs, reprint my own flyers, host my own open houses, repair his cheap yard sign ( when the wind blew the info sign dropped and all the flyers fell on the ground) and the last straw was he forgot twice to list my house as an OPEN HOUSE on his own web site. I e-mailed him that he was fired (he would not take my phone calls) and did not respond until I took all his cheap signage and put it in front of his office door.He said the only way he would release me from his contract was to give him a cashiers check for the full amount.

I bought more signs, printed better flyers, listed on a few web sites, and doing OPEN HOUSES every weekend. And getting a lot of traffic. If I have to pay Rick Kopp for doing nothing then it will just be another lesson learned. But I will not go down without a fight. I just found out about Ripoff yesterday and it makes my life easier. I have been contacting every listing Rick Kopp has and I found others that are unhappy. I also tried to contact there main office, but no response. I will re-write them this time addressing the letter to Hale Martin (thanks Bill in Georgia) to see if the company is all bad.

Assist 2 Sell and other discount brokers like Help U Sell work in a sellers market when you can LIST IT AND FORGET IT. They sign you up and do nothing. If another broker sells the house you still have to pay them 3%. you are better off selling the house yourself or finding a broker that will work for you. RELEASE ME FROM THE LISTING CONTRACT!!!

The response from Assist 2 Sell Corporate office was extremely professional and to the point. We obviously have two very diffesrent scenariors presented, and one must weigh evidence. I'm sure if Frank is in a need to sell situation one must consider his anxiety. That being said you are a professional, and it would've been best to not respond at all. Your response in my opinion was unprofessional and unnecessary. Your response, even if you are in the right, would cause me to not utilize your services. You should consider how those reading your responses will interupt what you are saying.

My name is Rick Kopp. I am the Broker and Owner of an Assist-2-Sell Real Estate franchise in Chandler, AZ. Assist-2-Sell is one of the leading discount real estate brokerage franchises in the U.S. I am known as one of the top Broker's in the Phoenix area. My services are known to be effective and I have hundreds of satisfied clients to prove it.

My rebuttal is targeted to the millions of potential consumers of Real Estate services that might be affected by the one individual, Mr. Frank Creter. The internet is a tool that does give an individual a tremendous voice in world today.

Mr. C has entered into a contractual relationship with my company, a local Assist-2-Sell franchise in Chandler, AZ, to list and sell his real estate property. The contract states all of the terms clearly and has been followed by my company to the letter. Mr. C is an informed, intelligent and responsible adult and has signed this contract voluntarily.

Apparently, Mr. C has no qualms about breaking contracts that he has signed. His method of attempting to break his agreement is to spread disinformation with verbiage that could be deemed libelous and slanderous throughout as many channels as possible.

I have offered alternatives for sensible settlement of this issue to which Mr. C has not responded.

It is a free country and we are allowed to say whatever we want. We are also allowed to say whatever we want about another person as long as it is true. If it is not true, then it becomes libel if it is written and slander if it is stated. With freedom of speech comes responsibility.

Mr. C has made numerous inaccurate and false statements. I have provided more services than even the contract states that I will for Mr. C. Mr. C has been the beneficiary of these services from my company.

I choose not to respond to each and every accusation that Mr. C has made because I believe that most rational consumers will see those as meaningless and/or untrue.

Please fell free to contact me or Barry. I realize that like many places in the country the AZ market is tough right now. I certainly can appreciate your concerns. You need everything working right.

Thanks for not taking the position that a bad experience with one person equates to a total condemnation of a business model.
I'm sorry you've had trouble making contact with corporate and I can assure you we will give this matter the attention it deserves.

As far as our model working in a buyer's market, it does work. In fact, in a buyer's market our model offers significant advantages.
We don't mandate MLS but we always offer MLS as an option. In a buyer's market we emphasis that MLS is a marketing tool every seller should consider.

While each office sets their own programs and fees, typically the "MLS for Less!" program offered simply adds the compensation to the MLS selling agent to our flat fee. Example: $3995 plus 3%.

If sold by the listing Assist-2-Sell office, the fee typically reverts back to the low flat fee. One advantage many sellers elect is what we call our Buyers Incentive Program (BIP).
Sellers take that same 3% that is offered to the MLS agent and allow us to offer it as an incentive to buyers that purchase through the listing office. (Not allowed in all states.)
Example: $300,000 sales price. BIP = $9000! Seller pays the same as if it sold through the MLS. Note: This is an optional program.
Traditional brokerage models typically are unable to offer such programs as their model involves keeping the entire commission if the property sells by the listing office.

Another advantage is our low fees allow sellers to price their homes more competitively and net the highest dollars compared to paying a higher commission with a traditional broker.
No broker or business model can magically make buyers appear. Proper pricing is critical, and in many markets even that is not enough. Today's market is being heavily influenced by excess inventory due to over-building, and foreclosures. In addition, willing buyers face challenges qualifying for financing.
