Yesterday I received a collection letter from RJM for a Fingerhut account for things I would have never bought in a million years. For instance they claim I bought an item for $206.35 and one month before buying the item (yes one month before) I apparently bought an extended warranty for said item for $293.35. According to this collection letter the extended service plan was bought in 05/1995 and the item in 06/1995.

Does anyone else see any problems with this? It would be absurd to buy a warranty for more money than the actual item, never mind buying it one month before!!! Neither makes any sense. Personally I have never EVER purchased an extended warranty as I view them as a total waste of money (at least 99.999999 in to infinity present of the time). I have my entire life declined such things. Never mind to get one where it would have been cheaper to just get a new item if that came about.

Furthermore if you add this up it comes to $500 yet they claim my total debt is $855.49. Of course they were nice enough to offer me a few plans at savings. Wasn't that just so sweet of them (of course I am being sarcastic--don't doubt that for a second).

Then of course we have the fact that this would be, if I did buy such things which I did not, S.O.L--and you know what as far as I'm concerned RJM is S.O.L (change the words of course). (I couldn't resist that!)

I immediately put together a DV letter also requesting proof and citing such cases as Fields v. Wilbur (for them to provide me a complete payment history starting with the OC as provided by stated case). And of course also asked that they prove it to be within the S.O.L etc...etc..etc.. as well as cease and desist.

Anyway my research on these bottom feeders also shows that NYS AG Andrew Cuomo is going after debt collectors in NYS and guess who one of them is, yes RJM. I hope he gets them and gets them good!

I will be of course watching things and just waiting for them to violate the FDCPA or FCRA and then I will report them to the FTC and to Cuomo.

The story of Cuomo going after debt collectors can be found on the official NYS AG web page http://www.oag.state.ny.us/media_center/2009/may/may27a_09.html

It's good to see some people with authority finally going after these bottom feeders!
