I received a collection letter from RJM Acquisitions, and immediately attempted a phone call to inquire as to why I am receiving a collection letter regarding a Wachovia bank account that has been inactive for 4 years! In addition to that, I had opened the account in July, 2000... this letter stated the opening date as May 21, 2004.... when I was out of the country!

So I called their 1800 number during normal business hours.... and they were closed. I decided to google their company in hope of finding a website I could send an email communication to, and instead found, under every result for RJM, something to do with "The Rip Off Report."

It seems this company has done this various times before, and from what I've gathered so far, most of their false claims deal with bank accounts. I am interested in the legalities of what do do here... I am trying to rebuild my credit, but i will NOT pay this false claim... any suggestions?

Do not talk to them over the phone for any reason. There is nothing that can be proved in court via telephone conversation. Also, the item listed by Michael in Number 2 is called a Cease Communication letter that can only be used against a third party debtor. When you send this letter do not sign it. Only provide your typewritten signature.

You have to be careful with these bottomfeeders. They have no qualms about lying in court. The thing about statute of limitations is you have to officially raise that as a defense in court. The judge will never bring it up.

Monitor your credit with the three reporting agencies to ensure they haven't tried to tarnish your credit. If they do, send a letter to each of the agencies stating this claim is invalid because it is beyond the statute of limitations in North Carolina.

You should also visit naca.net which is a collection of Consumer Rights attorneys that deal with this issue. Be as informed as you can be to fight these low-life scum. Good luck!

Consumers:

If you received a settlement offer letter from RJM Acquisitions, LLC of Syosset, NY for an alleged debt that you may not owed, or barred from statute of limitations (statute of limitations are vary by States) or the debt has been more than 7 years then you shall do the following action against RJM Acquisitions, LLC.

1. File a written dispute of the alleged debt (certified mail return receipt). Under the Fair Debt Collection Practices Act 15 U.S.C 1692g(b).

2. File a cease notice pursuant to 15 U.S.C. 1692c.

3. If after receipt of return of signed certified mail return receipt and RJM is continuing to contact or reporting the debt to credit reporting agency, RJM is in direct violations of the FDCPA and FCRA.

4. You can file suit against RJM for violations under the Federal Laws or States Laws or both, and if you have been deny of credit because of the debt has been reporting to the credit reporting agencies, you can also asks for statutory damages (Maximum $1,000 per violation) under the FCRA and FDCPA, plus actual damage for tort claims under the State laws and punitive damage if you can shows that the reason of deny as the result of the credit information provided by RJM to each of the credit reporting agency.
