I had to make $840 for three months which started in April I finished in June.  Stated they would get me a modification through the Hamp program.  After the money was paid I was told to contact the NY office.  When I called to get a status they kept passing me around, everybody saying its not my case.  Finally the operator said it is being processed.  They did nothing I called telling them in August that there is a sale date Sept 4.  Tim Butler called left a message on my cell and sent a email that he will be handling the modification, and the best way to contact him is by email.

My name is Timothy; I have been assigned your file in order to process your home retention options.  The following documents are needed to keep the modification process moving forward.   This was sent 8/28 SALE DATE- SEPTEMBER 4 If we are unable to stop it the only other way will be to reinstate or file Bankruptcy

I don't even know what to say.

There were over a half dozen messages and voice messages left for you regarding preparing for a possible bankruptcy filing.

I had personally discussed it with you, you informed me that you had filed prior by yourself and you were aware of how to file.

The fact that you didn't file or reinstate the loan falls on you.

At this point the house has gone to sale and there are no modification options available.

I spoke with ASC this afternoon and my home was sold today, because your
> company failed me in having it stopped or postponed.  There is a
> redemption period.  I need to know what is your next step.  I finished
> paying in June what was required.  I sent every paper work you requested.
> Nobody worked on it until the last few days.  Then your company told me to
> be prepared to file bankruptcy, there was no one that would file a
> bankruptcy within 24 hours and if I could have afford the reinstatement I
> would have done it before contacting your office for help.  This
> is not right and it need to be fixed.  I was told that you would be
> representing me and if the mortgage company had any questions they were to
> contact your office.  Mr. Fannelly told me to contact the office in NY and
> they gave me the run around.  Nobody knew who was working my case.  I will
> be waiting to hear from your office.  When I heard that ASC was requesting
> more paper work I
>  contacted your office stating that I had already went through their
> office for modification and I was denied.  So why would you take me back
> through that company.  I need answers! to save my home before the
> redemption period is over.

I called ASC this morning and they advised me that they so not believe that there is a redemption period, however there is a thirty day window to request a rescission. I just submitted more documentation to ASC requesting  to rescind the property back to you. I will let you know as soon as I have an update for you.

What I told you was that I filed bankrupt before, through an attorney office not on my own.  In the state of SC you cannot just file bankrupt in 24 hours.  There is other prep work that would need to be done.  No attorney I called would file it in that short of time.  I was told that on last Thursday to be prepared to file.  At the end of the day on Friday I was told by ASC they were waiting on documents from your office, in order to stop the sell date. You know that is a lie a half of dozen times! try 2.  Your office dropped the ball your company had since June to work this out.  Never contacted the company until August 30, 2012.  You did not even contact their attorney office for ASC.  Like I said I would not need your office if I could have paid the reinstatement fee back in April.  I spoke to you on Thursday.  You know that was not enough time.  To even file it would have to be done in Columbia SC cannot be done here in Walterboro.  There is a redemption period after the sale date and your office should know what can be done at this time.
