Complaint Review: Robert Garcia Bar Manager Secretary Treasurer Fraternal Order Of Eagles Aerie 442 Santa Barbara Ca 93109

Hello i'm the New Vice President of Fraternal order of Eagles Aerie 442 Santa Barbara, Ca. I would like to ask the communities help in exposing a liar and a theif whom has been robbing and cheating our club for years. First he has lied to the community and our members claiming to be a 501c3 nonprofit charity and accepting donations as such. No Fraternal order of Eagles Aerie is a 501c3 charity. We are a 501c8 Fraternal beneficiary society, and donations to a 501c8 are not tax deductable. Second as our Bar manager he has not fulfilled his contract or performed anywhere near satisfactory as a manager. He violates his contract every day when he rings out the register alone. His contract states this is only to be done in the presence of both parties.Our by-laws also state this is only to be done in the presence of two trustees the weekly counting of the receipts.for turnover to the Secretary which possition he also holds.

If that isnt a conflict of interest. But wait it gets even better the Secretary turns it over to the treasurer who is also Robert Garcia. Our trustees know this and do nothing but rather than fire him they have fired our Bar Tender Lisa Andrade at his wifes request without pay and put her out homeless in the street after they let her stay in a storage shed behind the Eagles lodge. To make sure she was out in the street broke and with nothing they went as far as to Krazy glue the locks on the door. Lisa has congenative heart failure and her medication was locked inside. As a bar manager he's also proven to be so bad at the job. His performance at the job is criminally negligent. Our Aerie has gone further and further into the red every year since he became manager. we are at negative $25000.00 as of the last 990EZ he filed with the IRS.

Before Robert Garcia came along Our Aerie had $55000.00 balance at the end of the year. We also went from a zero in expenses to $91943.00 the first year of his management. Manager refils bottles of liquor, also purchases beer and liquor for resale from cosco. Doesn't pay taxes on wages or deductions from employees, no workmans comp paid either. Employees are paid 30.00 for an 8 hour shift plus tips. cash Money from hall rental and parking lot rental not entered into system. Taking Aerie property home to use, personal items purchased with Aerie money. Making personal loans to self with Aerie accounts. Using Aerie hall and not paying required fee. Charging a 25.00 fee for Permit and pocketing the money. Incorrectly filling out tax documents as a 501c3 charitable organization to receive donations and exemptions. Not maintaining building to safety standards, Renting of substandard and unauthorized housing, house behind Aerie built without a permit. Creating a stressfull and toxic work environment. Employees afraid to speak up . Hiring of undocumented Imigrants.
