My brother and me were tring to buy some real estate through Rock Realty owned by, Rock Edmunds. We decided to back out of the deal after finding out that the property was still in probate and that we had been misled by the Owner of the property and Rock Realty.

We have requested that Rock Realty return our $1,000.00 Deposit (earnest money)and was told they had no control over it that the person that misled us and tried to defraud us has to release the money.

Well here we are several months later and Rock realty still hasen't released our funds although, they have it in escrow. MY warning to all is to never sign a contract with Rock Realty and never ever give them any money because if the other party tries to rip you off Rock Realty will side with them as they did against us. Buyer Beware!!!

Since my first entry the situation has been resolved and our money has been returned. My appologies are extended to Rock Realty. I have recently listed my home for sale with Rock Realty and encourage anyone reading this ignore my previous comments about this company. I was simply ignorant of the law.

Unfortunately the Real Estate Company is probably correct. Here's what you have to do. File in small claims court for the $1,000 (plus court cost) against the owner of the property and in your case state all the reasons why the contract was voided. Make sure you were within all of your contract dates and the breach was on the owner's part. The owner may not even show up because it's your money in escrow. Once you win either by default of the owner not showing up or the judge siding with you then send the documentation to the Real Estate Company via certified mail return receipt with a letter stating you won in court and you are demanding the release of the escrow money. The Real Estate Company may contact you telling you it has to wait 30 days to make sure the owner doesn't appeal the decision and then they will release it. They have an escrow account in which they can't even give you the money back if they wanted to. If they did this and the owner didn't agree to it then they are on the hook with the owner for the $1,000 plus all kinds of escrow violations. If the owner then comes back to them with the case that he didn't authorize the release then the Real Estate Company has a court order which will protect them from all liabilities. You'll win it back easily but you have to go through the proper channels to do it. Check your local laws for your state but most of them follow these guidelines in regards to this case. Good luck
