With a tax problem pending I call Roni's office and a Mr. Brandon Funk asked me a couple questions regarding my finances then asked me to hold so he could check with the Senior Attorney if I had a valid case, he came back with the aswer that based on my monthly costs it was clear that I could not pay back the approximately $16,000.00 in taxes owed and I qualified to be an un-collectable account with the IRS. I asked him if they would guarantee what he told me he said no attorney would guarantee that and I understood that, he than told me as long as I had been thruthful with my monthly costs and other financials I gave him it would be no problem. Then said I nneded to send the retainer to get the ball rolling. I sent them $700.00 and two days later I received a package from them with a agreement which stated the the uncollectable account would only be putting the total amount owed on hold but I would still be incurring all penalties and interest charges for ten years tripling the amount I owe the IRS. I called them upset about this told them I wanted help not to get screwed and I wanted my money back. I was told I had to write a letter to Mr. Christian Montgomery with a statement of why I feel they should give me my money back. I have not sent the letter because I am guessing the answer will be they spent 2 hours putting together my package and file a power of attorney with the IRS and 2 hours @ $350.00 Hr. equals what I sent them and I do not need anymore heartache over being screwed by these very bad attorneys.

Find a REAL tax attorney and get the help you need - I would also tell this attorney what happened and see what can be done about the monies this scam artist stole from you


Good luck - I have inside knowledge about the IRS being the daughter of a CPA and my Father's advise would be the same! Get a REAL Lawyer

SAME SITUATION WITH RETAINER

I am in the same situation as the previous person.  I was luckier though and only put down $350 of the $500 they asked me for.  I received my paperwork and continued to talk to my case worker regarding the wording of it all.  I never filled out any of the paperwork or signed any agreement with them. They never talked to the IRS for me.  It all seemed very hinky to me, so I told him I was not interested and wanted my retainer back.  So in essence they never did any legal work for me.  He also told me to write a letter to Mr. Christian Montgomery requesting a refund of my retainer.  I faxed a letter to the office on May 13th, 2010.  I received a letter dated May 17th, 2010 saying they would review my file to determine whether I am entitled to a refund of any unearned fees.  They would contact me in writing to advise me whether I am entitled to a refund of any unearned fees.  I called their offices about a week later and asked what the status of my refund was.  The person who answered the phone told me they had 35 days to decide whether they would refund my money or not.  I just called today (35 days from the date of the letter) to see if there was any news about my refund.  Someone answered the phone immediately, I told her who I was and why I was calling.  She said "please hold", then hung up on me.  I called back quite a few times and only got one other person and they hung up on me also.  All I told them was my name.  It's not like I even got to complain or even be mean!  I finally called the payment line and acted like I was going to make a payment when someone got on the line and they knew it was me (obviously by my phone number).  I asked my question again and he told me that they had 35 days to decide.  I started to say that my letter was dated May 17th and he said goodbye.  I said hold on.  I asked why was everyone hanging up on me?  He said that they probably didn't want to talk to me.  Can you believe it?  I have never been mean to them at all (until the phone call at the tax preparers phoneline, trying to get a number where I could talk to someone without them hanging up on me and that was just before I talked to him, so I know he didn't know about that).  I said "Excuse me" he said "your refund is being reviewed and we have 35 days".  I have never in my life been treated so horrible by a business before.  If I don't get my refund I will be going to the California Attorney General's office to complain.  I know to alot of people $350 is not alot of money, but to me it's whether I keep my lights on or not.  By the way, I called the IRS myself and did an Offer of Comprise with them on the phone.  The agent I talked to was so helpful.  It took about 1 1/2 hours to do the whole thing.  That's all Roni Deutch would have done for you anyway (if she would have done that at all)!  Don't be afraid, call the IRS yourself.  I'm telling you, a weight has been lifted off my shoulders as far as my tax problems are concerned.  Also,  you were not screwed by attorneys,  in your case attorneys never even saw or heard anything about you.  It was just those people that answer the phones that everyone thinks are attorneys.  No one ever talks to an attorney.  I will let you know what happens with my refund and let you know if it is worth sending a letter.
