On 12/19/05, we gave Ronny Poole d/b/a Ronny Poole Painting a check for $6,000, which he cashed the same day. He spent part of the next two weeks trying to install wood floors.

Mr. Poole moved our furniture out of our master bedroom, ripped up the carpet and pad, took them with him to keep, and never installed any kind of floor. Only the cement was left.

Mr. Poole admitted on 12/28/05 that he didn't know how to install the floors, but he has refused to refund any money.

To start with I did not get $6,000.  Over half of the money went towards material.  Dr. Shaughnessy knew when I started the job that I was a paint contractor and I wasn't a floor man.  I did tear the carpet out, but was told by Mrs. Shaughnessy that I could remove it and to haul it off too.  What would I want with some old carpet that was a peach color?  I put in a lot of hours and even got a few friends to try to help me out.  I had contacted a floor man to come and he ended up not showing up.  All said and done, the amount was nothing close to what was stated here.

I have done over 35 years worth of honest, professional paint contracting in some of the finest homes in Midland, TX. I have so many references that I couldn't begin to list them.  I did most of my work by referals and so this estimation of my work does not bother me in the least.  I bit off more than I could chew and that is the truth to the matter.

Addressed This Before

Don't wait. It might be a stretch, but file a theft report on the carpet. Get your or an attorney to send him a letter telling him you are going to sue him for the money PLUS damages and attorney's fees. Hit him with both barrels and DON'T WAIT.
