Complaint Review: Roy Phillips Amoco

Roy Phillips Amoco took car in for an oil change and the mechanic failed to replace oil of course the engine blew Overland Park Kansas

MY DAUGHTER BOUGHT A 1995 SATURN ON 8/18/05. THE DEALER AT A1 USED CAR TOLD HER IT HAD BEEN 4000 MILES SINCE THE CARS LAST OIL CHANGE. ON 9/12/05 WE TOOK THE CAR TO ROY PHILLIPS AMOCO FOR AN OIL CHANGE.

THE MECHANIC DID NOT MENTION ANY PROBLEMS WITH THE CAR WHEN WE PICKED IT UP AFTER SERVICE. ON 10/15/05 THE ENGINE FAILED. THE CAR WAS TOWED TO KING'S AUTO SERVICE IN STANLEY, KS.

THE MECHANIC AT KING'S EXAMINED THE CAR AND FOUND THAT IT HAD LESS THAN A QUART OF THICK BLACK DIRTY OIL IN IT AND A DIRTY OIL FILTER. HE FOUND NO SIGNIFICANT OIL LEAKS AND NO OILY RESIDUE THAT WOULD BE PRESENT ON THE CAR IF IT WAS BURNING A LOT OF OIL.

HE SAID IF CLEAN OIL HAD BEEN PUT IN THE CAR HE WOULD HAVE DRAINED CLEAN OIL OUT OF THE CAR AND IT WAS HIS OPINION THAT ROY PHILLIPS EITHER DIDN'T CHANGE THE OIL AT ALL OR DRAINED THE OIL AND DIDN'T REPLACE IT. THE CAR NEVER SMOKED OR LEAKED OIL DURING THE MONTH BEFORE THE OIL CHANGE, IN FACT IT HAD BEEN DRIVEN 4000+ MILES.

ROY PHILLIPS' INSURANCE COMPANY, UNITED FIRE GROUP, DENIED THE CLAIM SUBMITTED STATING THAT THE CAR BURNED 4 QUARTS OF OIL IN 1000 MILES.

If you have all of your paperwork in order, I think you would have a very good chance in small claims court, especially with a good mechanic as a witness that there were no oil leaks nor signs that your car burned oil excessively.
