Early in February 2013 we purchased an RV that in 2009 was registered in Iowa with 48,000 Miles (we didn't know this until using CarFax and checking state registration documents) but we were told the mileage was just over 39,000.  When the electronic dash failed and parts were replaced it indicated mileage of more than 66,000.  A time of purchase we were convinced to buy an extended warranty good for 30,000 miles.  Because of the false odometer reading which is listed on the contract we paid almost $5,000 for a warranty which now has less than 4,000 miles left on it and we have driven the vehicle less than 500 miles. 

Several of us were in the office when the manager asked to to sign a document he said was just a common practice thing about consignment purchased as is.  He did not give us time to read it while at the same time assuring us that the vehicle was being taken to a top RV and diesel repair shop here to have problem with the dash readings (air pressure) fixed and that the company would look over everything and anything that needed to be repaired would be fixed or they would tell us what was wrong and needed to be repaired.  Needless to say, when it came back from the shop we were told that everything was working fine and there was nothing except a few minor things that needed to be fixed - like a loose shower door.   We purchased the RV 3 months ago and so far it has been in the shop for major repairs all but 10 days of those 3 months.  The supervisor at the same  shop where we have taken the RV several times now for major repairs told us they were not asked by RV Consignment Specialists to check the vehicle over, just to fix the dash boards.

Computer Dash boards failed and had to be replaced again.  After appx 2 weeks they have failed a 3rd time which means no dash readings at all.

The compressor for the dash air conditioning was missing and a smaller belt had been used for the alternator and other belt driven parts to offset the length required by the missing compressor.  The air conditioning hoses for the dash air were all rotted almost completely through and had to be replaced as did all parts of the dash air conditioning system including in addition to the above new condenser, all the valves, the evaporator and all the parts in between these parts. 

The transmission turbine sensor is faulty and the motor home which has an Allison 6 speed  will not shift out of 1st gear and it will not let you manually shift gears.  The vehicle must be stopped, restarted numerous times for it to allow the transmission to  shift.  The vast majority of time it stays stuck in first gear so the motor home is no longer usable nor drivable.

The heater core was temorarily kept from leaking via some method prior to our purchase, but the first time we drove it appx 110 miles it began leaking severely which caused to have to repeatedly refill the radiator on the trip.  It had to be replaced.

The topside 2 air conditioners did not work properly and the the thermostat did not work properly and as a result neither heating nor cooling zones could be made to function properly.   The air conditioners and the thermostat had to be upgraded replaced. 

There have been many less costly repairs needed along wth the above. So in other words, we have paid including taxes almost $60,000 for a motor home we cannot use and a warranty we immediately lost almost 90% of the value.  And again, we were told repeatedly that anything that was found to be wrong major or minor and that needed repair we would be told about it/them before we signed the final papers.  We have scheduled a week and a half vaction for my wife and I along with my 80 year old mother to go back east where they were raised so they could see family and friends they had not seen in many years and my mother would be seeing family and friends she had not seen in more than 55 years.  Now we have to cancel everything including the reservation and RV parks and just let the motor home sit.

We are now talking with an attorney and there are 2 TV stations here in Phoenix that publicly address these types of issues/problems/fraud etc. and we have arranged to talk with both channels so the public will be aware of the business practices of this company.    My sister-in-law is former employee of the AZ Atty Generals Office and she is assisting us in filing a formal complaint.  Do not do business with RV Arizona Consignment Specialists under any condition.  It will be a disaster and cost you a great deal of money and time and in the end you will most likely end up with an RV you cannot use.

AZ Consignment RV is getting a raw deal here, although I understand the feelings this person has about the situation I don't believe they understood the business.

AZ consignment RV sales is not an RV dealer they dont go to auctions or sell new RV's peoplpe that wish to sell thier used drop them off in a location where they can have quite a selection at reasonable prices.

The condition and status of the RV is determined by the seller not this business they just get a commission for the sale.

I did buy one the condition was great I countered the sales price and the seller met me halfway on the purchase price I offered. There was no pressure to buy or anything.

The paper this consumer signed is indeed standard and it explains what and how you are buying. If the mileage was messed up it is the seller who signs that odometer statement not the consignment dealer.

I feel for the loss this person suffered and his advice is well taken look over what you sign during any transaction.

 It's your hard earned money your giving them and you let them push you into signing? Also, never let the dealer inspect the vehicle prior to purchase. Of course you know all these things now and it is of little help. Perhaps your attorney will get you justice. The false mileage is a violation of federal law but there is no telling when it was changed, perhaps by the original owner. Good luck with your case, I hope you get proper justice.

Dale At one time I own an RV repair business. And in the past many law  firms have hired me as an expert witness when it comes to cases such as yours. I have a few questions for you.  Can the RV dealership show you that they own the RV or was it on consignment ?  Can they show you any records of doing a predelivery inspection before they put the RV on the lot for sale ?  Can they show you any documentation that Reveals that they have done a leak check of the LP gas system to make sure it isn't safe operation before you took delivery of the coach ?  LP gas systems that have leaks are extremely explosive and an untrained person has no clue how how to  detect whether the system is leaking or not.

Do they have any documentation to show the output Operating pressures of the LP gas regulator ?  Did they show you any documentation That reveals whether they did a leak down test of the LP gas  system ? Also if the refrigerator is a three-way power operation refrigerator, That being it operates on LP gas or it  can operate on 12 V or it can operate on 110 AC.  If the refrigerator can operate on three different power sources one at a time then it has ammonia gas inside of the refrigerator. do you have any documentation to reveal to you whether the ammonia gas in the refrigerator has ever had or shown any signs of leaking ?

 

The biggest question I have is did the RV Dealer reveal to you any documents that came to them from the owner of the coach ? I wonder if the dealership can provide you or your attorney with any documentation of predelivery inspections of all the coaches that are currently on the lot ? I mean we have to ask does  this dealership do any kind of inspections on what they put on their lot for sale ? 

 

If you are willing to invest in hiring an attorney you need to have your ducks in a row before you file the suit. You also have to find out through the documents that you have signed when buying this RV Did the dealership get you to sign any arbitration clause documents ?  Most dealerships that being auto dealerships and RV dealerships nowadays get their customers to sign Arbitration documentation.  Arbitration is a tool that used to prevent you from going after them in a court of law.  

 

you're loped a major  law firm here in the valley with a case regarding one of the largest RV dealerships right here in the state of Arizona. Actually the RV dealership is one of the largest RV dealers in the country. The RV dealership sold a coach a brand-new motor home That had been wrecked in the whole face of the motorhome had to be replaced.  This was over $300,000 motorhome.  The RV dealership failed to reveal to the buyer that the coach had major front end damage. 

During my time on the case as an expert witness I had revealed 27 pages of repairs that needed to be done to a brand-new coach.  It was obvious to me that the coach dealer did not like to do predelivery inspections.  I also discovered that the RV dealership had submitted fraudulent documents with forgery on them to the court as evidence.

 

Needless to say the RV dealerships attorney that was representing the RV dealer did not like me being on the case as an expert witness.  He found it extremely difficult to overcome my discoveries.  If you're the order of the RV and you plan to hire an attorney to represent your case you need to make sure that you have an expert witness on your side of the fence.

 

The reason I say that is because an expert witness that is very familiar with all the systems on a motorhome can testify how explosive the LP gas system is and what kind of risk you are taking driving it Not knowing if the RV dealership has done a leak down safety test on the LP gas system.  Let me explain my concerns

 

Now we are going to talk about propane and the expansion rate.  If you have one liquid gallon of propane in a container, And you open the valve and you release the propane from the container into the atmosphere.  That one liquid gallon of propane in the tank expands to 270 gallons of explosive vapor.  So the expansion rate is. One Liquid gallon of propane equals 270 gallons of explosive vapor.  Now if you have 25 gallons of propane in the tank  That is equal to 6750 gallons of explosive vapor once released into the atmosphere.  And the atmosphere that we are talking about can be inside the coach.

 

It is extremely important that any person planning on buying a recreational vehicle needs to make sure that the selling party has revealed a complete predelivery inspection of the coach and I mean a complete inspection.  If you hire Hey law firm to help you you need to make sure that you have a law firm that knows how RV sales contracts are put together. Your lawyer also needs to know the importance of an RV predelivery inspection report and how one should look. 

 

For your law firm to help you with your case he needs to know what Kind of ammunition that he needs to win the case. If he does not know that you are wasting your time and money.  Also you need to look at the documentation From the previous owner.  I am sure that between the RV dealership and the previous owner they know or somebody knows the current condition of that coach before it was put on the lot for sale.

 

And I'm sure that you were never shown any documentation from the previous owner as far as past repairs. That might've revealed to you the name of the previous owner.  Did anybody reveal to you any documentation of safety operation of the chassis  such as the breaks before driving it have the brakes been inspected Before it was placed on the lot for sale they did anybody show you that documentation ?

 

I personally can be any RV dealerships worst nightmare involving a lawsuit. Once you file a lawsuit it will be recorded with the superior courts website.  After that,  action can take place.  Ask the RV dealership what other documentation that they have that they have not shown you.  Between the owner of the coach if it was on the lot  as a consignment unit and RV dealership I personally believe that there have been or is documentation that has not been revealed to you all the current and past condition of the RV.

 

Footnotes to all who are thinking a buying a motorhome.  Never be willing to buy a recreational vehicle without documentation to reveal to you where the seller has had a complete and full predelivery inspection on that coach and it must Include a LP gas  safety inspection including a leak down test.  It sounds to me that there are way too many things wrong with that coach for it to even be put on the lot for display at any RV dealership.  And some of the parties involved knew that.

 

Dale make sure that your attorney gets the name of the previous owner of that coach at subpoena documents from the previous owner. Make sure that your law firm gets the documents of when that coach has ever been at or repair facility you need documentation.
