On Sunday November 24, 2002, client Rear Ended my automobile On Monday November 25, 2002 at 09:00 am. reported to Safeway On Tuesday November 26, 2002 was contacted buy Erin and reuested to fill out a form she was mailing and told a Claims Adjuster would be out on possibly On Friday November 29, 2002 or Monday December 02, 2002 at the latest.

No one called or showed on these dates. On Noveber 27, 2002 I faxed Erin a copy of the police report On Tuesday December 03, 2002 again contacted Erin to iqiure why no one had called or showed up.

On Wednesday Deceber 04, 2002 again contacted Erin and was told claims adjuster would not answer page.

On Thursday December 05, 2002 again contacted Erin and was told claims adjuster would call shortly.

On Thursday December 05, 2002 Claims adjuster arrived and inspected auto and iformed me report would not be ready till Friday December 06, 2002.

On Monday December 09, 2002 I was contacted by Erin on the phone and was informed that car had been declared total loss and that another dept. would contact me.

On Tuesday December 10, 2002 I was contacted by Madalyn and made a settlement offer on the claim, that I did not accept.

On Wednesday December 11, 2002 I was contacted by Madalyn with another offer that 2k shy to replace the car with, but did accept cause I was told it could be a year for arbitration.

On Friday December 13, 2002 My husband contacted Erin about rental car restitution and was informed od safeway's company policy.
On Monday December 16, 2002 left a message for Pam, Erins supervisor to call me

On Tuesday December 17, 2002 left another voicemail for Pam, and went to safeway and was give what I feel like was the run around.

On Wednesday December 18, 2002 We have recv'd no return call from Pam yet!

I feel that we done all we could to try to get this accident settled and behind us as quickly as possible.

Safeway client was legaly charged with following to DUI and following to closely Causing this accident.
There was nothing we could do to prevent this accident.

I have been without the use of my car for fifteen days. I was told I would have to pay for the car out of pocket and recomeneded to a couple of car rental company's by a letter in the mail Upon arrivial they wanted cash and a credit card.

Right here I christmas I had neither

So for that reason I have done without a car for 15 days. I was told Safeway's ploicy was 5 days at $20.00 per day $100.00 max. I was willing to accept that in good faith. Then I was very sarcasticaly told that I would need to produce a receipt and that if I did not I was not entitled to reimbersment. I do not have one and do not feel that I should need one. I offered to write you a statement if needed. I was refused to be given a Corp. Name or phone # and have yet to have my call returned by Supervisor (Pam I was told) in Atlanta.

Now it is a matter of princiable

I feel I am entitled to rental car restitution for 15 days @ the going rate of $20.00 a day. $300.00 on car rental that I feel I was ripped off for and $2000,00 on the car

They insure a known drunk and then it cost me $2300.00
how could our goverment let this be a legal pratice

I am very unhappy with Erin Keating's attitude toward this matter and the fact her supervisor Pam did or would not return my call.

FYI- Even though the innocent victim doesn't agree with Safeway's insurance policy they do have the option to take matters into their own hands by contacting their own insurance companies. It is not required by law to pay any loss of use or rental when a vehicle is a total loss, unfortunatly the person who presents a claim to an insurance company has the burden of proof and must submit documents to support the loss that they are claiming. Without proper proof of a claim there will be no obligation for that insurance company to pay anything. People might not like or appreciate it but if they file a claim with any insurance company they will find the same problem.
