This company lists Crystal Bay Caterers (founded by Sam LoPiccolo) on their web site as one of two primary caterers they use. I recently came across some disturbing sanitation and safety inspection reports conducted by the Division of Hotels and Restaurants on Crystal Bay Caterers. This information is posted on both this web site (The Rip Off Report), Florida Department of Business & Professional Regulations web site

As a public service, I think current and future customers should be aware of these facts – and of course this web site -  The Rip Off Report -  offers Saffer and Company an opportunity to respond to why they are promoting and using Crystal Bay Caterers, which has such a poor public record of sanitation  (that has resulted in actual fines against Crystal Bay Caterers – according to the above mentioned reports ) – all of which means Saffer and Company could be subjecting their customers and guest harm (i.e. food poisoning) due to a lack of minimum due diligence of their official vendors.

I just saw the update on the Rip off Report of Crystal Bay Caterers Sam LoPiccolo, your preferred caterer on your web site

This new post has court records that ranges from lawsuits for ripping off vendors to possible domestic violence.  When you say “Hiring the right professional for your charity and benefit auction is just a good business” is Crystal Bay Catering an example of your professionalism and good business sense?

These are some very serious charges – and they are backed up by third parties like the Tallassee Democrat, Florida Department of Health and Sanitation, open court records of the Clerk and Comptroller, Palm Beach County - and NO ONE has rebutted them - no one has claimed they are not true (though government public records are hard to disprove)

Why are you just ignoring this charges? At least update your web site and preferred vendor list with more reputable vendors.

Otherwise - Shame on you.

In my above post I both said you did nothing wrong, it was not a complaint against your company, and you most likely did not need to talk to a lawyer, or if you did, as a plaintiff.  It appears I was wrong on all counts.

The linked article (URL link provided at end of message) “Don't Be Misled by Deceptive Business/Charity Marketing” references a court case were 12 state Attorneys Generals sued American Cancer for allowing a company to give the impression that the ACS endorsed it products and services by allowing the company to reference it’s name in marketing material (other defendant was SmithKline Beecham Consumer Healthcare, L.P.)

As a result of this court case The American Cancer Society adopted new policies to guard against inappropriate uses of its name …..and to discontinue…..such marketing arrangements in the future.

1) I found out American Cancer Society may have been a victim of sanitation negligence of Crystal Bay Caterers (founded by Sam LoPiccolo) because ACS allowed it's name to be used on the marketing web site of Saffer & Company - who promotes Crystal Bay Caterers (founded by Sam LoPiccolo) services as an extension of their services.

2) Even if American Cancer Society did not use this catering services for it’s Saffer & Company event (or for other events where they contracted said caterer directly, based upon the marketing web site of Saffer & Company)  - this or other Rip Off Reports could uncover those that did suffer injury or harm due to Crystal Bay Caterers (founded by Sam LoPiccolo) sanitation negligence; and those individuals could fairly claim their decision to use said caterer was influenced by this referenced marketing piece.

 

I do think you do need to talk to a lawyer with negligence experience, but as a defendant, not as a plaintiff
