On August 25, 2004 I was informed while applying for a home refinance that Sallie Mae had reported to all three credit bureaus for being behind on my payment to Sallie Mae Servicing when in fact my loan was in forebearance. I am in the process of fighting them now. For some reason I cannot get above the first level supervisors. Anyone with any luck please let me know.

Questions:

1 - does Sallie Mae Servicing (http://www.salliemae.com) reflect the forbearance in the account history? If you haven't signed up for it, you'd better start.
2 - did Sallie Mae send you a statement reflecting the forbearance? Anything in writing?

If #1 is true, a simple printout of the page showing the forbearance period should be sufficient proof. You don't need to get past the first level sups - just let them know you can fax them a copy of this. They'll get it taken care of - and if they don't, you can always dispute it with the bureaus using that printout.

IF #2 is true, same as above.

If #1 nor #2 are true, then there's no proof of the forbearance, and when a forbearance is placed on an account, there -MUST- be confirmation sent. If you didn't get confirmation at the time it was set up, unfortunately that falls back onto you.

Even if they didn't send you a confirmation letter, they should still have been sending you monthly bill statements reflecting no payment due.
