Complaint Review: SAR & ASSOCIATES

SAR & ASSOCIATES Said the are representing LTS Management. They say i owe them money. I do not know who or what they are. They say they are going to proceed with pre-litigation action against me, claiming my account is severly past due and is now in internal civil procedures departement . Plantation Florida

Received a letter saying i was severely past due for a company I do not know saying they are going proceed with pre-litigation action against me. The compant is LTS Management saying I owe them money, and they turned it over to SAR & ASSOCIATES.

I just want to start by saying that I have worked in collections for a number of years and know of what I speak. First off, ask for a copy of the original debt. Most of these fly-by-night places don't have access to that information and will probably send you some sort of form letter from THEIR company advising you of the debt if you ask for proof. Also, ask them for the number of the original creditor. Nine times out of 10 the creditor will have no idea who they are because they probably never placed that file with that agency to begin with. A lot of these disreputable agencies nowadays buy accounts for pennies on the dollar that have been sold numerous times to other agencies and they just happen to be the present owner of that account...until they exhaust efforts to collect on it and then they'll sell it to someone else. Now I'm not suggesting that you don't owe a debt. It's very possible that you do. I would just do a little more research before you agree to anything. In some cases these companies may even be attempting to collect on a debt that is outside of the statute of limitations (meaning that they are no longer allowed to even ATTEMPT to collect on it). Also, get familiar with the FDCPA. It's a set of laws set up specifically to police third party collection agencies. These laws protect the consumer and are supposed to prevent collection agencies from using unfair or unlawful business practices to collect on debts. I hope this helps.
