Complaint Review: Saxon Mortgage Services - Meritech Mortgage Services - Texas Commerce Bank - Texas Commerce Bank Nat

After my wife Beverly became suddenly ill in the spring of 2000, we were trapped financially due to escalating health care costs. During this time, our Mortgage was with Saxon but they transferred the loan to Meritech to our detriment.

Meritech refused to work with us so we fell behind on our payments, approximately $16,500.00. To make up for that, Meritech demanded $10,907.17; that exactly 66.1/3 % in fees, totaling $27,406.14.

Trapped with escalating medical bills and a blatantly corrupt company & predatory lender, we had no choice but to file for chapter 13 on December 15, 2000. After that date, we made payments to the mortgage through the Chapter 13 Trustee until December of 2002.

When Saxon's illegal and predatory prepayment penalty expired on the 5th year of the loan in January of 2003, we obtained a $350,000 dollar loan and asked for a payoff amount.

Now, at that time, Saxon was now "again" servicing the loan as they were was back in the picture as Meritech had filed bankruptcy. Saxon, knowing very well that we were in chapter 13 demanded to be repaid all money the Trustee had paid to Meritech but with huge and unspecified charges added to the bill.

Mr. Ted Widing, a good and honest man with federal resources got working on behalf of the family as the Attorney In Fact for our family; he quickly took over the case and the negotiations with Saxon.

But Saxon was refusing to provide a payoff amount and continued to stall, causing delays from which they unjustly enriched themselves by charging exorbitant interest and penalties for delays they themselves intentionally created on a predatory loan they wanted paid off as they want the property which is worth millions now. Saxon stalled, refusing to accept the $264,000.00 payoff we thought we owed.

When their tactics failed, they sent their top predatory attorney Ms. Tait. Andy told her in good faith during a phone conversation about the $350,00 loan he had secured to payoff the mortgage and the next day, Saxon demanded a payoff amount which they had refused to provide suddenly, withour documentation jumped to $377,000.00

Apparently, at that point something drastic happened because Ms. Tait started a personal vendetta against Mr. Ted Widing and our family.

In March of 2004, Ms. Tait went to Pierce County Superior Court and obtained a summary judgment and filed for foreclosure and started the foreclosure process without ever notifying us or our attorney in fact.

The acts committed by Attorney Jennifer Tait on behalf of her client Saxon and Texas Commerce Bank is BLATANT fraud. She knowingly and intentionally attempted to steal our home and land without giving us notice and denied us due process in violation of our constitutional rights.

In April of 2004, we went to court and proved we had never received notice from Tait and her fraudulent acts came to light. The judgment was reversed but the court did not discipline the attorney nor sanction her as required and Saxon got away unscathed.

We owed Saxon / Meritech / Texas Commerce Bank (whatever name they are using at the moment they fleece the customer) $260,400.00 plus change.

All charges they have added after our payoff request in January of 2003 is the sole responsibility of Saxon/Meritech/Texas and not us. We attempted in good faith to payoff the loan but Saxon/Meritech/Texas refused to accept payment which is an indicator of a predatory lender.

This is blatant fraud. So we are now before the court to have their summary judgement thrown out for the second time, but now the FBI nd the Department of Justice is involved as well as the Attonrey General of Washington State.

Saxon, Meritech, Texas Commerce Bank, Chase bank of Texas or whatever they call themselves are PREDATORS, PREDATORY LENDERS! BEWARE OF SAXON, MERITECH, TEXAS COMMERCE BANK.
