I signed a contract
with Focus Inc. on April 28, 2009 for the purposes of generating leads
for me for my Reverse Mortgage business. They
contracted to deliver leads at $100/lead starting approximately two
weeks after receipt of the funds. Leads had to meet a certain criteria
as specified in the contract (they had to be the homeowner, occupying
the property, 62 years old minimum, clear title to the property,
proceeds from the Reverse Mortgage had to come within $10,000 of paying
off their current mortgage if they had one, home values were to be
between $150K and $650k, correct contact information included with
lead, etc.)The contract states that the term of the contract shall be two
months following the first day of the start month. Since I understood
that their advertising campaign would not start until approximately 2
weeks after I signed the contract, This made the start month June 1,
2009. Under terms of the contract, I expected to receive 35 qualified
leads from the first $3500 by August 1, and from the second $3500 by
October 1. In actuality, they never charged the second $3500. I began
receiving leads on approximately June 8. They were slow coming in and I
called and e-mailed my contacts at Focus expressing my concerns. I
eventually received a total of 22 leads. The last one that I received
was on September 8 and that was the first one received for several
weeks. I returned 13 of the 22 received for credit because they did not
meet the terms of the contract on one or more ways. I copied Focus Inc.
on every return and my reason for return was never disputed. After
having left several messages with my two contacts at Focus that went
unanswered and having sent several e-mails which also went unanswered,
I filed a disputed charge with my Credit Card Company on September 8.
In
summary, I contracted for 70 qualified leads and paid for 35 leads in
advance. Any non-qualified returned leads were to be credited as agreed
to in the contract. I received a total of 9 qualified leads. They kept all of my money and no one in a position of authority there will communicate with me. I have been cheated out of $2600. I have recently seen evidence that they are continuing to attempt to sell this program. This company appears to have no integrity and no business ethics. They have despicable business practices and do not do what they tell you that they are going to do. I don't want any more Mortgage Brokers to get cheated out of their money.
