On 11/08/2009 I made the mistake of having a oil change done at the Fiesta Mall Sears Auto Center. The idiots admitted to damaging the door to my brand new vehicle with an air hose. Seems the moron manager Mike released a air hose with a very strong PSI right into the side of my car. They said they would fix it if I got an estimate which I did. Their "Loss Prevention Nuts" claimed it was to high and should only cost around $150 to fix the dent and the paint. I explained to them its a 2008 with 3,500 miles on it. I did make the manager write down that he did damage my vehicle before I left. The damage is more like 1,600 to 2,000 dollars, this is a new car and Sears did a large amount of damage. Sears had their "LOSS PREVENTION" Jerks call me up and tell me that they needed a copy of my credit report, Social Security Card, Copy of my Drivers License,Auto Insurance card and Birth Certificate and vehicle registration to prove that I really owned the vehicle. They told me if I did not take the $150 settlement that it could be years of court proceedings before I ever got my vehicle fixed and then the lawyers would take all the money.
Needless to say I'm not an idiot and nor would I ever give them such information. I took the vehicle to the certified BBB Auto body repair center for the repairs, filled out the lawsuit and paperwork to serve the statutory agent, paid for the repair using my 21% interest Sears Master Card. I figured when it comes to damages Sears needs to pay the interest that they fleece their customers with, think they will argue with the judge that the interest is unreasonable? I will also ask the court to grant me the filing fees, time lost from work, rental car expenses, and several thousand dollars for the decrease in value do to the claim that will be reported on Carfax Reports. My damaged car is now worth way less than what I paid for it. To add insult to injury after they damaged my vehicle, made me wait 2 hours to get my car the morons charged me for the oil change. I can't wait to have my day in court with these idiots. I plan on taking the judgement papers and making flyers out of them to distribute to every home in a 2 mile radius. I also have phone calls into the local news stations asking for help from their trouble shooters, this will make a great news story! Oh the BBB thought the complaint was incredible.

I love how so many posters here go off half cocked. Before you get your pants in a wad, just send them (certified) a letter demanding the amount owed within 15 days. After the 15 days just file a small claims suit. No lawyers, no aggravation.
All your histrionics will do nothing. Also, the value of the car won't be affected by one small dent.
PS-I think the damage will cost far less than you think.
