Sears Canada Will not refund for faulty product Kingston, Ontario

I purchased a Nordictrack T9ci treadmill for $1706.29,on 10/16/09 took delivery on 10/22/09. The treadmill console broke on 13/11/09 , reported it for service was fixed on 10/02/10 but was found to have a incline motor problem as well and that was repaired on 10/03/10. Console broken again on 01/04/10.


Tried to get Sears to take back their junk but they are going to charge a 20% restocking fee. They have decided that this unit can be fixed again. Now here is the catch, the treadmill is worth $1700, the repairs to date are $1786 and they need to put another $1000 in it for a new console.......??????????????? All I want is my money back and they take their piece of crap machine back. I was only able to use this treadmill for less than a month and they want (20%) $340 to take it back.


They say I cannot get a full refund because I did not fall with-in the 30 day return policy. My arguement is that if I reported a problem with-in the 30 days and it was not repaired properly then until they repair it properly the 30 day period is still open and I should be entitled to a full refund. But they argue 'they deemed it could be fixed'.


I will NEVER purchase another product from Sears!!!!!!!!
