About 5 months ago i was shopping at sears when i got a shocking phone call.My father had passed away from a sudden heart attack . Well at the time i was in the perfume isle and spraying tester well not paying attention i put a emty tester bottle in my pocket didnt even relize i had done well they stoped me and my husband on the way out the door and confronted me i argued and then i relized what had happened and tryed to explain. and asked the most sensible question. why would i steal an emty bottle of perfume on purpose

my husband offered to pay the 19 dollars anyway when they took me back they had a hispanic man there as well whom was compairing prices and size and was accused of stealing he produced a reciept and now the judge of this case is trying to give me 180 days for this and sears is trying to charge me 250 for this i think they should have thought the situation out better after all they were just itching to bust someone anyone i will never shop there again and i have a lot of friends and family whom have credit cards with them and they have all stopped shopping there they agree with me they should pick there employes a little better they are very uncompassionate......

I think you're being a bit hard on the Sears security staff. Let's look at this from their perspective. The bottom line is that you put something in their purse and walked out the door with it. Period. There's no way to clarify upfront which person was stealing intentionally and which person was just distracted and made a legitimate error. They were just doing their job.

The fact that your father died is sad, but it's totally irrelevant to the criminal case. I think we can all agree that people steal all sorts of weird items, so the "Why would I steal an empty bottle?" bit won't hold water with a judge.

Okay IF what you are saying is true that is truly a tragic set of circumstances.  But there are a couple of things that don't make sense.

You didn't mention the time line between the call and when they stopped you.  Did you go directly to the exit once you got the call or did you do more shopping?

You didn't mention anything about presenting your case in court. This would include showing your Dad's Death Certificate to collaborate your story.  So you did do that right?  When you did what did the judge say?

Because if the judge is trying to give you 180 days(in jail?) that means you have been found guilty.  If this is a first offense, even though the statutes probably allow it 6 months in jail seems very harsh even without any other circumstances.

Either you had a very "hard a**" judge or you are not telling the entire story, and I wonder which one it is.
