We have been trying to get rid of SPS for several months. We had to file Bankruptcy to catch up on payments. Then they started returning our checks saying they needed payment to be in cashier checks. THis made our account accure late fees and interest. Because of this, they got a relief from the courts to proceed with Foreclosure. We finally got someone to refinance us. The payoff was good until 11-12-05 for $114029.31. On 11-16-05 they received a wire of funds in the amount of $114531.49. They got an additional $500.00. SPS tells me that this is not enough. We need to pay them an additional $1878.13 within a week or they will foreclose on the home. They said that the payoff was late by 3 days and that the per diem is not good for my account since it's in foreclosure. They were so rude. How am I suppose to come up with an additional 1800.00 within a week? They explained that the fees are for late charges, interest and attorney fees. The problem is that I never received anything from SPS saying that I owed any additional money. I called them to make sure the account was satisfied. Then to top it off, the $114531.49 they received is not posted to my account. So the account continues to accure interest. I need an attorney but can't afford one.

Shonda, I have also been a victim of SPS and I even filed a "class-action" suit here in Tampa, Fl. Won the case, but that has not stopped them from harassing us. Please search the web and find an attorney (or my attorney) who is willing to file a suit against them on a contingency. My story was even reported on the local news, and it has not helped my case. SPS is ruthless and do not care, but you can't sit and wait for them to hit you. You need to take action now.

I also had the same problem with Select Portfolio. The title company sent the payoff on 10/4/05 and they did not post until 10/15/05. They only posted because I called everyday demanding that it be posted ( they were charging me intrest daily. They received over 1500.00 over my pay off amount and were trying to keep all they could. They kept saying that the payoff was short.

Call the everyday and demand that they post. They also need to back date to the date that they received your payoff. Then request a "schedule of fees" They will not send this on their own, you will have to request this and they have 14 days to send this to you.

They will try to send a copy of your account that you can pull up on the internet, but that shows no fees. If they do this, call back and request again and send a copy to the FTC.

When you did your refinance did you take any additional cash out? Also, I would be in contact with my mortgage broker to discuss this with them! They are the ones who ordered the payoff and paid off your loan, it was up to them to get an updated payoff on your loan.
