My husband and I have had problems with Select Protfolio Servicing since they took over the mortgage on our house in 2000. We are currently in a forebarance for the second time since 2000. This time the forebarance came about due to SPS not accepting a full payment when we had gotten 2 months behind. I was out of work for 2 1/2 months last summer and we were trying to get caught up in December of 2006 when they refused our payment. They sent the check back, 1 month after I had sent it in!!! We had already set up another payment, for the amount of 2 months, through Western Union when we received the check back. There was no correspondance that told us they had not accepted the payment either. When we received the check we called to find out what was going on. They told us that they had put us in foreclosure and that they had already sent paperwork out. I also asked about the 2 months worth of payments that we had sent in Western Union. I was told that they returned it and that I could just call Western Union and go pick up the money. Well, that was another adventure. It took 2 more weeks and several phone calls to get that money back!!!!

We did receive paperwork about the foreclosure proceddings being started, Hoewver, it was dated after the phone call that they said the paperwork was already sent. We did enter into a forbarance to stop the foreclosure. We paid more than the noterized forms asked for which covered all of the past due payments. We also found in this process that the property taxes had not been paid for 3 years from our escrow that had been set up in the last forbarance in 2002. So SPS is stating that we owed a total of $14,780 to re-instate the loan. We paid over $7800 and the balance was to be put on a forbarance for an extra $500 per month. How does the balance less than $7000 equal out to 24 months at $500 per month?!!

We have paid to the forebarance in April, May, June and July. Then this weekend we receive a letter that they did receive our last payment and that the new balance on the forebarance of $7400 must be paid by 7/27 in order to keep forclosure from begining again. Our original balance wasn't even $7400!!!! Where did this come from???!!!!! I have pulled all paperwork and I am calling them today to find out what is going on now.

I have seen lots of postings about a class action, Is there one started yet?

I would love to be a part if there is one started. We can not afford to hire an attorny with the extra $500 we are paying for the forebarance!!!

I have an update to my forbarance with Select Portfolio Servicing. I have filed a report with the state Attorney General's office regaurding the extra charges that SPS has put on our account. My account was then transferred to the Ombudsman group of SPS. Basically this is a group that is supposed to be third party, however, I have not had much luck with them either. I am still being told that we owe over $1500 more than we agreed to on the Forebarance agreement that we signed. I did recieve an account history that lists every payment or charge on my account since they bought our mortgage in 2000. This has helped me understand what some of the charges are. They are broker fees, inspection fees, twice the amount owed on taxes, and attorney fees. I have read the class action files from 2003, which we were a part of, and it reads that they are not allowed to charge us for broker or inspection fees. Yet, I now have the proof that they are, as recent as 6 months ago. I am in the process of gathering all my copies and proof of the charges and my payments to send to the state attorney general's office, at the AG request. I will keep you all posted as to what is happening.

We have finally gotten the amounts taken care of. Hopefully. The letter was sent out because the auditing department reversed the application of our forbarance down payment. The reason we were given as to why this happened was that when an audit of our account was performed they could not find out check for the down payment. Well, they wouldn't because we paid with a bank transfer. It took calling twice a day for 2 weeks to get our over $7800 put back on our account.

Now everything checks out that we are up to date on our payments. However, we are still getting several calls and hang ups on our answering machine every day to call them. We try calling the two people we had working on the reversal of funds and can not get them anymore. They will not return our calls. HMMMM, this seems funny.

I will keep all of you posted.
