Complaint Review: Shapes Total Fitness

Shapes Total Fitness closed their South Tampa location on Swann Ave without notifing members. They are now says you either have to go to another location, which is not an option for me, or go to another Gym that will honor shapes south tampa members. When asked if I can just cancel my contract they said no. They said per their contract they have to provide a gym withing 5 miles and of equal quality. I stated to Shapes that the gym they are referring us to is not of equal quality, as in it is co-ed, there is no daycare, and no classes. This clearly is not of equal quality.

When confronting shapes they said in equal quality they are referring to the equipment. It clearly does not specify this in the contract. It simply says "The member may cnacel the contract upon written notice if shapes total fitness for womens goes out of business, or moves it facilites more than 5 driving miles from the business location designated in the contract and fail to provide, within 30 days, a facility of equal quality located within 5 driving miles of the business location designated in the contract at no additional cost to the buyer."

There seems more than enough rason to say the gym they are providing is not comparable or equal. Shapes is not allowing any members to cancel their contract. Non of the managers will call back from the corperate office.
