Shauna Taylor refuses to send 4 boys clothing lots as well as 3 girl clothing lots won on Ebay.

Total of 7 lots @ $109.99 ea. Total: $769.93 + $100.00 shipping = $869.93

They are still working Ebay however, they will not answer the phone number or emails I send.

Is it fair for a seller to take almost a thousand dollars from a buyer and not ship their stuff??

in THIS situation a chargback would be fair and necessary.

not all situations are the same, yours is much different than non recipt of items.

I do not think it is fair to lump all situations together, with an all or nothing attitude. Not all situations should be handled with a chargeback but some call for it.

How would you handle it if you spent a grand on something and the seller did not ship it?? Would you sit there and eat the loss thinking"well it would be unfair if I did a chargeback on this seller even though he did take my money and run."

I doubt it.

I do not agree that it is okay for a person to do a chargeback for something that should be covered under insurance like damage during shipping. that needs to be taken up with the shipping company.

Items need to be insured regardless of weather the buyer paid for it or not. Insurance is to protect the seller from having to refund due to shipping damage. It is up to the seller to provide insurance.

if you charge 10.00 for your shipping and handling and insurance is 1.50 then bill the buyer 11.50. Do not give them the option of not using insurance. It is the responsibility of the seller to get the items to the buyer in the condition stated.

Buyers and sellers need to work together to file a damage claim, as the seller will have the paperwork and the buyer will need to take in the merchandise and packaging for inspection by the shipping co.

I do not think it is fair to say that NOBODY should be able to do chargebacks because of what happened to you. Or that it is bad to advise somebody to do a chargeback to get his money back.

the guy spent almost a grand and did not get his stuff for crying out loud. What do you suggest he do then?

I am in no way promoting using paypal, i am just trying to help this person in their particular situation.

I know paypal will limit and sometimes freeze your account with them if you file a chargeback, but in this situation, at alomst $1,000 had the user used paypal it would be worth losing the paypal account if it ment the credit card getting their money back for them.

I have found that paypal only sides with the buyer when it comes to undelivered items not misrepresented items.

OP's items were never recorded, not misrepresented.

There are several payment companies that can be used to pay for auctions with credit cards. paypal is the most common.

I did however take a look at the sellers auctions and they did not accept paypal or any other form of online payment anyway.

So the OP needs to go ahead with the mail fraud and small claims court to get the money back if they have not gotten it.

I did see too on the sellers feedback that the OP left a negative for non-delivery of their items then left another asking where to send payment.(they used the dollar amount in their feedback so I know it was the OP)

in the auction itself it says NO PAYPAL yet the option to use it at checkout is still in the listing. Seller also says if you use paypal you will NOT get your items.

Since the buyer left the "I paid-wheres my stuff' neg. then sometime later left the "where do I send payment" neg.

I am betting they used paypal first, seller did not accept it so it was held in limbo for awhile since paypal does not allow a user to cancel a trasaction for awhile after paying.

Then finally paypal allowed the cancelation, and the buyer complained in the feedback about where to send the money.

From looking at everything this is my guess, but all in all i was just trying to help a buyer get their money back.

Not promoting anybody nor trashing anybody.

I had an experience with a crooked seller about a year and a half ago and in spite of having evidence that the seller KNEW what he sold me was not as represented, Paypal took his side. I then disputed it with Visa, who agreed with me and did a chargeback.

I was wondering how you paid for your items?

If you used a credit card through one of the online payment options (paypal, bidpay etc.) you can do a charge back with your credit card company and they will get you money back.

If you sent payment through the mail you can file mail fraud charges since they accepted payment but did not mail your items.

The seller is not a member of the ebay community anymore, as they are listed as an "unregistared user" now.

But all hope is not lost.

you have their address name and phone number, file mail fraud, and file a case in small claims court. you can print the paperwork neede right online. Since you purchased the items over the internet you can file right in your own state. It should not cost much money to do so.

I would laso email them and inform them of your intentions.

o to ebay now and print out the pages of the auctions you won from them, get a copy of your payment to them (a cleared check that has been endorsed with their name, money order that has been endorsed, or print a receipt from the online source you paid from)

use these as proof of your payment, how much you paid etc. and file right away!!

Also wondering why you did not leave them negative feedback for all of the different auctions?

I also suggest going onto ebay, click on community, then click on discussion board, find "feedback" on the list of topics, and click on it. At the top of the page the will be a thread about fraud links by mioka. there will be a lsit with links to file all kinds of fraud reports with different agencies.

My suggestions to keep this from happening again are: USE ONLY CREDIT CARDS ONLINE!! Your credit card co. will always protect you. And don't buy high priced items from people with such little feedback. If a seller has alot of good feedback and has bee around awhile you are alot safer when buying from them. And regardless of how much feedback the seller has do not buy from a seller with less than 99% good feedback.
