I originally went to Mr. Shears because I had been trying to sell my home for over two years without any luck.  I deeded my home to Mr. Shears, while the mortgage remained in my name and he received the tax benefits from the home.  He was supposed to pay the mortgage until the home was rented.  It has been three years and he has always been late 2-3 months on the payments, which is affecting my credit not his.   Everytime I would call to ask him about it he would give the excuse that he couldnt get renters or that they were late paying him so he just lets the mortgage get behind because he is not making a profit off it anyway & that he was doing me a favor by taking over the property.    I have asked him numerous times to deed the property back to me, which he refuses to do.  There are renters in the home and have been since I deeded the home to him.  I have always called the mortgage company to check on payment history.  Mr. Shears didnt have the common courtesy as a businessman to call to tell me what was going on. Now the home is in foreclosure status and he refuses to return any of my phone calls.  Please beware of this man and his poor business practices.

STATEMENT FROM SHEARS ENTERPRISES:

I don't know who this is or what this is concerning. It could possibly be someone that has rented from me before, defaulted on their lease and they were evicted from their residence. Or it could be someone whom I helped in the past by purchasing their home on a "subject to" purchase. Kept for many years, managed and paid down mortgage considerably. And, then upon their request of asking for property back, it make sense for me, and I sold the property back to them.

This person is a son to another person whom I did business with. Most everything he says here is False. This particular is a property I purchased in 2010 from his mother. She had nothing but good things to say about me. This home was struck by tornado's in 2011, He trespassed upon my property and started doing work prior to my knowledge, he then demanded money from me for clean up. This is when the agreement with his mother went wrong. He was not asked to be on my property nor was he especially asked to do any clean up. The insurance company had not even been there yet. When I refused to use him for repairs he became very upset.

Let it be noted that Dwayne referred to me as an "Unemployed Construction Like Worker" to the Atty General of Alabama.  This.. my friends, is "LIBEL"

He clearly knows who I am. You can reach me anytime.  He told me on the phone. "YOU CAN SUE ME. COME ONE" Well, I understand why he said it.. when people sues him he complains that he cant afford anything.... Which is quite ironic when he is able to continually sue others to evict them.. just yesterday June 14th he paid over $200  for an unlawful detainer. He total Civil Case Load is at 70 cases total now. Its slowly moving up.. that's just for about 5 years!!! In addition he lives in a nearly $500,000 Home.. WOW!!!!!!

Let me confirm that I have proof of my full employment status and I can produce all documentation that you want or need.

Dwayne has registered his business address at the wrong place. If you serve him at 1354 Moss Rose Ln, He will not be served. I currently see 3 Active cases for horrible real estate practices on alacourt. Every one tried that address first because that's the one he has registered.

I promise you will have not only his correct address, but lots of information about him to. All information I have is available to the public.However, the letter where he has written the attorney general is not publicly available YET.

If I am challenged I will be ready to produce all evidence in the public domain. In fact, I am prepared to setup a webpage to reveal to the public all the deception that has occured. All evidence includes  not only faxed letters, but emails, and court cases that I have found where he has also harassed tenants which he rents to to.

Please.. if you have been a victim, please.... I can not say it enough... contact the news... and... post a message on rip off reports. I think people have been reading these and starting to pursue cases against him.

Again, I do not know who this is! notice its from anonymous. My guess is that it is an attorney trying to cash in on a frivolous law suit. There is not merit to what is being said regarding "subject to" purchases. "subject to" is referred to most all real estate books used for training agents nationwide. Property has been traded by way of Contract(s) and Deeds for decades, actually since the beginning of records. So to say what they are saying is totally false. I have been in business since 2006 and plan to be for many more years to come. I have helped hundreds of families get into and out of homes that otherwise would have been foreclosed on.

Im very sorry to hear what has happened. Just to let you know I live in hoover alabama and have been keeping up with this Dwayne Shears. It appears that you are not the only victim.  You can search ripoffreports and find another filing against him for the same thing almost.

Im quoting this from an article i was reading on subject to loans:
"With the increase in foreclosures, banks are becoming more aggressive on going after real estate investors that do not make the mortgage payments on properties they purchase subject-to.They are convincing the state attorney general to sue the real estate investor. There have been several recent court decisions against real estate investors that failed to make payments on subject-to properties. If you thought that you had no legal liability when purchasing a property subject-to, think again."

He will not get away with this. He wouldn't publicly explain the previous case saying he wants to keep all this private. In addition you can search the alabama court system online... all cases are publicly available and you can see he is being sued by a few people for contract problems. In addition, he has over 65 District/Civil cases against him or against someone else, in addition to a previous bankruptsy that happened less than 20 years ago.  

Furthermore, you can goto jefferson country online court system and also attain a list of properties that is owned by him. I searched st. claire country, jefferson county , and shelby country and found a large sum of properties that have been deeded to him. 

My question would be this... if he had several judgements against him.. how would they handle all these properties that are deeded to him and the mortgage is in other persons name??? Would the leans hurt him?? or the REAL owners who have the financing? Its a horrible thats happening here.  

I seriously recommend you contact a lawyer.  What he has done is illegal. While you signed the dotted line and transferred the property, that was legal under alabama system. However,  In Several states it is now illegal to sell subject to.... if he was collecting rent and not paying the mortgage and let it foreclose... thats ILLEGAL. and you must sue him. Most likely the people living in the house was under contract to rent with option to buy or rent to own. I assume most people he targets have very low income and have no way to sue him, thats why he has operated over 5 years now.

If he truly has a justification for these multiple complaints on ripoffreport.. Please type your answer. open up to the public and let us know what the truth is. I don't want my property value to drop because of you letting homes foreclose. Also... clarify the complaints you had to the BBB... I see he also has a few there to.

Again... remember... Always do your due diligence.
