Yamaha Motorcycle Scam Ripoff

We made our purchase from SHY Stockton Honda Yamaha Dealership.

They weren't shy in ripping us off. We bought a 2005 V Star street legal Yamaha. Like Beverly of Grass Valley, Also with understanding it would be a regular financing. Only to find out once recieved first bill it was financed thur credit card. And we were already behind in payment before first bill arrived. Also they had ( retail Services) had already contacted the 3 credit reporting companies. Closing our account for non payment.

IT took nine years to clean up our credit from past relationships (we both been married before.) WE finally had credit and it was real good. Not now. There never was a post mark on bill, just dated on letter or bill inside. So couldnt prove when we recieved bill.

One time we got bill the same day the typed and mailed it. LOL right. That was when we got a bill. They called and called us. When they raised out payment from the $89 payment to 126.00 and then to 300 something amonth we called and told them we just couldnt afford it and wanted to turn it in they would not let us. We contacted Shy. They wouldnt help, cause the already had there money from Retail services. Steve didnt care They all made money on our trust in them.

Finally 6 -7 months later they finally had a guy come get it from us as we turned it in. YA right again. Now they say they repoed it and we had 15 days to pay or auctioning bike off. WE owe more money now that we did the day we got it. OH ya payment went to 6oo amonth. We brought for no down payment. $89 a month for first 2 years and 5% interest and payments would never get highter than 127 amonth. Bike only had 1300 miles on it when we gave up.

Big company's have big money to spend on taking us to court. But like Beverly said time for us all to fight back. WE are in with the class action suit. Is there a honest lawyer out there that can or will help us.

CONSUMER DID NOT PAY ATTENTION TO DETAILS OR MAKE SCHEDULED PAYMENTS OR FOLLOW UP WHEN THEY DID NOT RECIEVE THIER BILL

WHEN THIS MOTORCYCLE WAS PURCHASED,
THE FINANCING WAS EXPLAINED IN DETAIL!!

Anyone with any common sense READS what they are signing AND asks questions if they don't understand.!!

And for those who don't listen to us as we explain the terms of their financing, and those that do not read what they are signing, Yamaha even has a picture of a hand holding a Yamaha Credit Card on the front and back of the Application! It is very apparent that the application is for a credit card. The application (with the heading ?Yamaha Motor Corporation, USA Card Program?) was filled out and signed by this buyer!

Not only did the customer sign the Credit Card Application and Card Holder Agreement when credit was applied for, the customer also signed a Sales Slip for the purchase with field descriptions such as Cardholders Copy, Cardholders Name and Cardholders Address. Obviously referring to the fact that the sale was transpiring on a credit card.

The Sales Slip signed by the customer also stated that the $89 payment and 4.9% APR would only be for a promotional term of 24 months.

The cardholder agreement states that if scheduled payments are not made as agreed that a default rate would apply. This is a standard practice with ANY credit card company.

The reason the payments and finance charges later escalated greatly is due to payments not being made in a timely manner.

STOCKTON HONDA YAMAHA CAN NOT BE RESPONSIBLE FOR INDIVIDUALS WHO DO NOT MAKE THIER PAYMENTS!!!

?I DID NOT RECEIVE A STATEMENT? is an excuse that is only good once --- NOT MONTH AFTER MONTH!!!

If the consumer does not recieve a bill from the finance company (for any reason, lost in mail, bad address, ect.) Stockton Honda Yamaha has no way of knowing this, BUT THE CONSUMER KNOWS THEY MADE A PURCHASE AND KNOWS THEY DID NOT RECIEVE A BILL. If the consumer follows up in a timely manner with the finance company 99.99% of the time the finance company will waive late fees, correct address and even acept payment by phone and honor the original terms of the agreement from that point forward. Of coarse none of this can happen with out the consumer being pro active in a situation that only he/she is aware of !!

After the customer contacted us with questions regarding the payment schedule and such, we promptly and happily provided him with several contact phone numbers for the financial institution to assist him. We even contacted the bank on his behalf asking them to contact the customer directly.

Stockton Honda Yamaha has no control over the customer's financing after the sale. The customer's agreement to pay is with the financial institution. When payments are not made, the financial institution takes action with no input or care for what the dealer has to say.
IT'S NOT THAT WE DID NOT HELP THIS CUSTOMER; IT IS THAT WE COULD NOT HELP THIS CUSTOMER.

We were not aware of this report until several months after it was posted.

In conclusion, there should be contact made by rip-off-report.com to the reported company so that a timely rebuttal can be made. Let's be fair to the merchants as well.
