Simm And Associates Abusive, creepy, shady Newark Delaware
Someone from this company phoned my neighbors across the street looking for me, which is creepy because their name is not on their mailbox and theyve never met me. They brought me a note and I called Simm and Associates, or Simms Associates, getting a different wording with each call.
Ken was not in so I got to deal with Tracy. I told her that since I only had a note from my neighbors I needed her to mail me something with the company letterhead and official information before I transmitted any money by any means. Though Id been civil and even friendly, at this point she flipped out on me and began a long, loud rant that I couldnt break into, telling me I knew the company was legitimate. I told herin a calm voice that I was trying to set up a payment plan, but she hung up on me instead.
I called back and asked for a supervisor and was told none were on duty since everyone was working overtime. Huh? Then I called to see if I could get a different representative, but got Tracy again. This woman acted like I owe her 500 bucks personally, that I stole from her ailing grandmother. She insulted me, raising her voice higher and higher, telling me shes been doing this job for years and can tell what a phone call was leading up to. I told her she'd read me wrong because I had been trying to make arrangements to pay the debt and was only making a request any smart consumer would. Again, she hung up on me, singsonging, "Im so sorry this was unpleasant for you...have a nice daaaaayyy!" She was beyond rude; she sounded like I'd activated her evil twin personality. I couldnt get over it.
At one point she gave me Simm's mailing address, but I was unable to get a phone number from 800 information or local information in 302 area code in DE. There is also no listing on DE's BBB.
I was told that I must send money via Western Union or postdated bank draft immediately and that a postal money order would not be accepted and they dont take mail-in payments. Tracy told me, "Honey, I cant tell you if it'll rain tomorrow, but I can tell you that if you dont call Ken by noon tomorrow we WILL take these papers to the magistrate and they WILL begin procedure to arrest you. IS THAT WHAT YOU WANT? DO YOU WANT TO BE ARRESTED?" she hollered.
She'd mentioned something earlier about garnishing my wages. So it's completely unclear what method they plan to use, and, as I said, I was not given opportunity to make any arrangement whatsoever.
And now I wonder if I have a stalker because I dont know how this Ken guy found my neighbors or their phone number. Ive contacted the state police and the PA attorney generals office.
I also need help in dealing with these people; I hesitate to even call it a company, as that implies some set of rules to operate under.

Anyone contacted by this company and is verbally abused by any of it's employees should contact a lawyer. It is against the law , you have civil rights. There are certain procedures a collection company has to follow. DO NOT give them any of your banking information!!! Please listen to me and save your self the time and aggrivation. A lawyer dealing with this kind of debt can tell you anything you need to know.

I too have had a terrible time with this so called agency. Their personnel are abusive and confrontational.
I have their website address and mailing info for anyone who is looking for them. I will be sending a letter to the BBB and the Delaware Attorney Generals office if they do not comply with my request for proof of debt and valid information. They send letters without account information or proof of debt. Yet they actually expect you to just send them money. Yea, ok...

I laso recoment you look up on the internet US TITLE VIII SECTION 8 or 15 USC 1600 and refresh yourself with the law regarding the Fair debt Collection Act.

The address for them you have is correct. I am from DE and have horrible experiences with them as well. Contact the DE Attorney General's Office with your complaint and CC: Simms. When I did this, they finally responded to my complaint. The tele# listed is 302-832-7549. A collector can not threaten you or verbally abuse you. File a Cease and Desist order against them in writing and tell them that they are to have communications with you only in writing.
