My name is Sean and I have had a cabin rented on lake Conway for almost a year now. I have a lease and my rent is always  paid in advance. The utilties are on at this cabin, water, electric and cable so that when I do get down there I dont have to do much except dust and buy food to be comfortable. Now I have not been there since Christmas and then only to winterize the place and make sure it was neat and my property secure. I got a call from a family member a few days ago and he said the property was broken into and locks changed. I flew down from Alaska and arrived at the property and found that to be factual and that all the utilties were locked out and the door lock changed. There was a label on the door saying that secure properties found this property to be abandond. I contacted secure properties and informed them that the property was not abandond and that I was the lease holder. They informed me that I could not enter the property unless I contacted the owner and the bank. I contacted the owner by phone and told them to call the bank and get this strightened out as soon as possible. I found that the lock box was not securly locked and retrived the keys and entered the property.

From here on I was appalled at what was done to my property by the theives working for Simmons Bank and Secure Properties. Let me describe what I had to deal with over the next week. My cabin was destroyed, property stolen, and my wifes creamtion ashes and her cats were opened and some lost forever. These scum had broken into my home by breaking both door locks to enter. They broke a window, destroyed blinds. removed and broke the air condictioning unit, stole my food, hygene, tools, cleaning material, trash can and barrels, barbque grill, truck top and numerous other items. They threw my porch chair in the back yard and threw trash lumber on it that didnt even belong here. They turned all utilties off and closed my fridge so mold grew inside and stunk so bad no one could stand to be around it. The Kitchen facut was broken and my hot water heater had a leak after I cut the pad lock they installed on my water so I could turn it on. I also had a antique fishing pole my father gave me in the 1970s that was never used and now stolen. It may not be worth much but my father gave it to me before he died, you cant replace that.

I have my wife ashes and her cat at the property because this was the kind of place they love and I was sure they would not be distrubed. I was wrong at how sick some people can be. When I walked through the door I saw the the cats ashes were opened and the lid was bent in and my wifes framed photo with gold locket were sitting sidways against the urn. I repaired the cats urn the best as possible and repaired the photograph and locket so they hung right. I then looked at the table by my wifes urn and saw dust on the table, curtin and floor. I slowly lifted the urn up and turned it upside down and found the red wax seal over the screw was gone and the screws were marked from a recent tool. I was appalled by this discusting act against my wife and my family. Now I must figure out how to get my wifes ashes seperated from the dust and how to get her ashes from the curtin. These people sicken me with there acts. They broke into my home and destroyed it and they had absoluty no legal right to do so. I am sick about all of this and forgivness will not come easy or cheap. I am spending thousands in time and labor to repair and clean the damages caused by these people. Lets not forget the harm to me and my family that is beyond anything a Bank or company should be able to do under the guise of abandond property or winterzing home in spring time Arkansas in the 60 degree temps.

Clearly you seem to be mistaken, even if the owner and the bank are at each other it does not negate my rights as a lease holding renter. Read renter law on the issue and you will see that even the bank and secure properties must give formal notice to enter the property well in advance of doing so, neither did. Both Simmon Bank and Secure Properties acted like Nazis and broke into my home and stole, robbed, destroyed and descrated my wifes ashes, which they are not allowed to do. Yes it may be a rental but I am responsable for it and damages according to my lease. Therefore, the Simmons Bank and Secure Properties are responsable for the damages not the property owner, they didn't do it. It falls squarly in the lap of Simmons Bank and Secure Properties for violating my lease and my rights. My attorney agrees and says clearly you dont have a clue on this matter and he advices you read landlord tentent law to correct your skewered view.

You stated you lease this unit and that you had to call the owner and told them to get this straighted out.

So what did the owner say? If the owner, for example, failed to pay the Mortgage on the Property the lender had every right to do what they did. Your complaint and any claims would be against the owner.

I'm actually trying to figure out why you are spending all of this money to fix up a property you don't even own?  As again unless you aren't posting something this does not seem to be your fault and either the bank or the landlord look like they should be the ones responsible.

So what did you leave out?
