Sleepy's sold a non functioning adjustable bed/mattress combo Hicksville, New York
I am a 71-year old breast cancer survivor now facing pancreatic cancer. On 11/05/2011, I purchased a twin size adjustable bed from Sleepys 86th Street (336 E. 86th St, NY, NY 10028 tel:212-534-7836, salesman: Richi).
Because of my illness, I need an adjustable bed allowing me to raise my head or my feet or both, and a Latex mattress because I use heating pads and electric equipment which cannot be used with standard memory foam mattresses. I also need casters to move the bed which is located against the wall in my very small bedroom, for my medical care.
I was charged $1,774.61 (including a $89.99 delivery charge). I did not see the mattress I was purchasing. I was forced by the salesman to purchase a mattress protector ($40) meant to protect me from the toxic fumes of the mattress, I later gathered.
On Friday, 11/18/2011 the bed was delivered. No casters. The mattress was compressed and I was told to wait 24 hours to see it in its final state. It was already obvious that it did not fit the frame (two inches wider) gave off a foul odor, and was sticky to the touch. It was made in China, as was the mattress protector for that matter, and promptly caused me to be nauseated, with diarrhea and a skin rash. I could not sleep in my own bedroom, and had to move to my livingroom sofa, and keep all the windows open.
After several phone calls to the store, I went there, a hardship for a sick woman such as me. I was talked into spending an additional $780.19 on a "better" mattress, made in Pennsylvania. I had no choice, since there was none other at Sleepys.
New mattress, now costing $1,149 was delivered on Wed, 11/23/11 and Chinese toxic one removed. New mattress is 11 inch-thick, quite rigid and is not "adjustable". When the head of the base is raised, the mattress stands like a ski slope, not bending as it should, even with me on it, I am 118 pounds and in fact would slip right off the bed if I tried to sleep on it. When both head and feet are raised, the mattress sits on top of the end of the base like a plateau, 4 feet high.
I returned to the store with a friend and numerous pictures. Both store manager and salesman admitted that I now have a non-adjustable mattress on an adjustable bed, both useless, but insist that the store policy is to refuse to take them back. Since there is nothing else at Sleepys to fit the bill I feel strongly that the policy should be waved, and my purchase reversed, including the mattress protector and the delivery charge. I should also be compensated for the severe inconvenience: I have been exposed to a toxic mattress for close to two weeks, and unable to sleep in my own bedroom. I am too old and sick to sleep on a sofa.
Time is of the essence. I will be undergoing treatment starting 12/2/2011 and will need a bed and my bedroom cleared of this mess. I also need the money to purchase another bed. Sleepys has had it since 11/5/2011, nearly a month now.
