In March of this year a representative of SmartChoice named Dom Entrekin sold me cc processing services. He told me that after four years I would own the processing equipment, and he also told me there was no early termination fee. He said this in the presence of a witness, and he also wrote in big letters on the contract that the early termination fee was "WAIVED." I repeat, in big letters he made a point of writing next to termination fee "WAVED." He assured me there was no termination fee repeatedly and mentioned no other termination fees at all. After I signed and set up service, I learned that instead of owning the equipment after four years, I would instead either need to purchase it separately or send it back. In other words he misled me into thinking I would own the equipment after four years, but in reality I would not. I contacted the people who were "leasing" me the machine and they told me I could not cancel no matter what. I sent machine back in anyway, and they cancelled the lease. I also cancelled with Smart Choice Payments. I questioned Dom Entrekin about the lies, but after a brief exchange he stopped responding. I did not hear from Smart Choice Payments until today, November 12th. A "private investigator" called me and told me that Smart Choice was suing me for cancelling early. He told me half way through the call that the conversation was being recorded. He told me it didnt matter that the contract said no early termination fee, and that they were suing me for the costs associated with setting up the account. Sounds like a shameless semantic argument used to lie to customers. He said they were suing me for about $1,000! I notice that ripoff report has somehow said that Smart Choice cares about their customers and that if a complain is made that the ceo or someone will respond and try to make it right. Let's test that theory. If I am sued, I am so happy that I am in Beaverton, the same city in which Smart Choices makes their home. It will be easy to go to the media, they love to look into greedy companies that like to harrass and swindle small businesses. It will make a great story.
