Nothing but Thieves On October 18, 2011, as I was leaving Chula Vista I paid a toll with my credit card. Days later my credit card account showed a $3.00 charge for South Bay Expressway and its merchant number; and I received a citation notice falsely accusing me of evading the toll. To SBX, I sent an affidavit, copies of my credit statement both from online and by mail. I also requested a copy of the credit receipt. Over the Thanksgiving holiday they sent a letter posted 11-23-2011 stating I had evaded the toll. They even declined as to send proof upon which they were relying upon to maintain their position that I had evaded the toll. I even gave them my e-mail.

They said my explanation fell into a category for which they have chosen to reduce your penalty to a onetime courtesy of $10. I had two options: (1) Pay $13 ($3.00 toll +$10 fine) and say I evaded the toll or (2) Pay $63 for a hearing. Do you think I was actually given seven days to pay in accordance to the notice. Not!!! I received this notice on Friday November 25, 2011 and they want payment by Tuesday, November 29, 2011.

So lets get this straight. You timely paid the toll. SB Expressway accuses you of not paying. You send legal proof that you paid--with their merchant number on it. They still accuse you of failing to pay the toll. If you contest, they want to pay you to pay the original fine for a hearing. If you dont contest they want you to pay a smaller fine and lie to cover-up their faulty system. Either way they get a hold of your money drawing off of it what little interest they can in the interim.

They evidently intend to cause as much financial and personal strife as possible to force people into giving them money they do not deserve. I intend to fight because this is wrong. I wont lie to cover up an inept system they brag is so great. Once maybe excusable but two times. Get real. If there is an attorney for a class action put me down. The toll is a scam and I intended to notify consumer agencies, governmental offices about fraudulent business practice, and whomever else I can. Based upon my experience, I recommend avoiding the Chula Vista area until South Bay Express has their systems reviewed, revamped, and corrected.

Our goal is to provide convenient access to travelers in South County not to scam anyone. We feel it is fair to ask that customers pay for their trips when they use South Bay Expressway a toll road. We provide both cash and credit card options at each ramp, as well as a Pay-by-Plate program available via our website, by mailing in your payment, by calling or coming by in person to our offices to do so. With all those payment options, we still extend the courtesy to our customers and to those unaware or who were lost and confused but used South Bay Expressway by reducing their penalties as a one-time courtesy. It is the responsibility of each driver to be sure that they contact us to pay for their tolls and when violations are issued. The reduction in penalties instead of elimination of them is done to cover the administrative costs associated with sending a violation when it is valid. This includes collecting the registered owner information for the vehicle at the California DMV, staffing, processing, printing and postage for each violation. If South Bay Expressway were to make a mistake or issue a violation in error, we wouldnt ask for payment in any penalties from the customer. If an error was not made, then we do ask that at a minimum, drivers pay the toll and often times a reduced penalty.

these people are thieves they give you an opportunity to go through the hassle to fix something that should not even be going on to begin with because we paid these people need to be shut off... people don't have time to go through your gimmicks and charades because they are charged for something they already paid ....consumer i hope you read this if u have encountered anything similar to this posting a ripoff report won't fix the issue a class action lawsuit will lets shut em down email us as closethesouthbayexpressway@gmail.com I'm working on getting the turko man on this all people who have encountered issues with these people speak up if we unite we can shut them down free the toll for hard working san diegans free the freeways no more tolls
