We want a full refund of our $4500.00 deposit from Southern Pool Company due to direct breach of contract. Our efforts to contact Chris Hyde (owner), Wendi Brantley (finance), or Gary Bragg (salesperson) have been futile. We have tried endless phone calls and have forwarded two FedEx delivered letters. The first letter was dated 06-20-07 and the second on 08-20-07.

On 05-17-07 Gary Bragg, a salesperson Southern Pool Company, came to our home for a 6:30 appointment to discuss the installation of an inground pool. Mr. Bragg went into great detail regarding next steps and that whole process would be about 30 days. Based on theose terms we provided a $4500.00 check for the deposit. Gary left us preliminary documents as well as multiple contact numbers.

From the initial meeting to date, Southern Pool Company has deviated from every step process that was outlined by Gary and has not delivered a pool or even started the process. Chris only contacted us after we sent the first letter via FedEx on 06-20-07 voicing our dissatisfaction over the lack of any work done by the company other than cashing our check and the threat of legal action.

On 06-22-07, Chris contacted me at work, and I conferenced my husband on the call as well. He stated that they had experienced a family emergency but now the entire process, including the pulling of the permit, would be completed within 30 - 40 days from the date of our conversation (06-22-07). It was upon these terms that we allowed the company to retain our funds.

The company's voicemail says that they have a family emergency and will return calls as soon as they can. None of our calls have been returned since 06-22-07. Gary was contacted by my husband. At no time did he communicate any knowledge of a family emergency that was hindering business. The letter dated 08-20-07 outlined in detail all broken commitments and asked for a refund with 1 week from receipt of the letter. We were not been contacted by anyone.

On 09-06-07, we filed a complaint with the Better Business Bureau. They made several attempts to contact Chris Hyde to no avails. As of 10-05-07, they have received no response.

Angry does not begin to explain how we feel about this situation. We are going to continue to pursue all avenues available to get our money back and have them held legally accountable. If anyone that has also filed a complaint would like to work with us to take steps in pursuing a class action suit, please let us know ASAP!!

Contact the local police and file a breach of trust complaint. This will make it a criminal case and not a civil case. There is a big difference. A civil case will only get you a judgement against them (which means very little). A criminal case of breach of trust will get your money back alot faster. Breach of trust over $1000 is a felony. But you have to prove they never intended to do the work, just out to take your money. I did this same thing and got my money back rather quickley.
