Complaint Review: Southway Building Corporation

I saw an ad in the yellow pages for construction management services so i contact the company and spoke to the the owner peter zarcone.'i told him i was looking for a construction manager to manage the construction of panelized homes to be built and he said he could manage the jobs for $25,000.00 per home.

I found three lots and went to contract on the lots and he said that he would need a deposit of $25,000.00 per home because he would need to get the plans drawn and approved, get surveys and topos for the lots and pay for the permits before we could close on the construction loans and get a draw from the lender.

I gave him $25,000.00 between september and october 2006 and he filed for the permits and they were turned down. what i didn't know is that his permits prvileges were blocked and he was the straw owner of the company and the real owner is a marion county public official.

when i requested my deposit back because he could not get the permits he refused and i filed a suit against him and he counter sued and got a default judgement against me for a million dollars claiming that i ruined him and his wife's standing in the community and for defaming him all for filing a complaint with the attorney generals office.

when we went to court the mr zarcone,s attorney lewis dinkins saw that my witness was the licensing supervisor of the building depatment he filed a motion to block him from testifying claiming it would be prejudicial to his client.

The judge called a meeting of the attorneys and about an hour later my attorney came out of the judge's chamber and told me that they are getting ready to enter a judgement against me and i have to settle and the contractor wont settle unless i pay him $110,000.00 and that she has seen worst and to make matters worst her husband works for the state attorney's office.

Ihe contractor actually got a judgement based on false testimony and the state attorney's office has refused to make an arrest and i wrote to the governor and the governor's office is saying that he wont second guess the state attorney.

I fired that attorney and hired a new one and when he looked at the file that atty renee thompson sent he saw a lot of motions with no response from the judge so hw went to the courthouse to check the file and thev motions were not in the file.

Word on the street is attorney dinkins and judge singbush had been personal friends for many years and the state attorney wont make an arest because the real owner of southway building corporation is a marion county public official.
