I'm being ripped-off On 11/23/2005, The day before Thanksgiving. I was in the middle of fixing stuff for Thanksgiving. The UPS deliverd a box I didn't have time to mess with it at this time. So I put it in the corner of my bedroom. Then 11/26/05 I open the box and in it was a Sprint LG cellular phone.

I called Sprint to let them know that I did not order or want this Phone. I was told IT'S a free phone why wouldn't you want it? I forgot about it then for about a week later I recived a billing statement of $65.43 so I opened it again and took it to a Sprint Dealer in my home town. The lady at the sprint store looked over my paper work that came with the phone.Service and plan Informaation. The plan I was on and that the screen on the Phone was defective. She also told me that the Phone was already activated and it would cost me $150.00 Dollars to deactivate the phone I didn't order it in the Frist place.

So I decided to keep the phone if they would fix or replace the phone. Now mind you I have been running all over Gods Creation for the past two weeks in this area trying to get this Phone fixed.

All I get from these people is the run-around, pass the Buck, I'm not responsible that it was an on line servey from In-Phonics, that gave us a 1-888 number that was disconnected. Then they gave us a LG. MFG. number to deactivate the phone to send it back to them so they can fix it while we sit here with no phone and being charged to deactivate the stupid thing.

In the first place a ten year old filled out the servey and sent it. So how is that for getting Ripped-Off by mistake if that don't beat all, and all we wanted to do is get the phone fixed after getting screwed into keeping the thing. Really Feeling Ripped!!!!

First off some one getting a phone on the 23rd and don't open it till the 26th and then finding out that it has already been activated tells me that the phone was activated when it was sent. To my understanding that if there is a $150.00 Dollar Deactivation Fee for a phone that has been activated, and it was activated before it was sent, this sounds like entrapment to me. So when these people said dishonest, and Fraud that sounds right to me. Did the package say (Don't Open Unless You Intend To Keep It?) probably not, did the package say (This Phone already Activated) evidently not. In all reality this could very well be a serious matter that should be looked into, (Wouldn't You Think)? What if it had happened to You?

Ellen, WHY does a 10yr old have.....

#7Consumer Suggestion

Ellen,

WHY does a 10 year old have unsupervised access to a computer on the internet?????

Do you know how dangerous this is?

As far as the order goes, all you had to do was dispute the order in writing to Sprint, and the unoped package should have been IMMEDIATELY returned with signature confirmation requested.

This is all very basic and very easy. Ask them to send you a copy of the contract you signed or a recorded call log of the order.

The burden of proof is on Sprint to PROVE that you made the order, it is not on you to prove that you did not.

And, your 10 year old would have had to have quite a bit of your personal information to actually complete that order. No Sprint cell phone order can be activated without a SS# and a credit check. NONE.

I feel there is much more to the story here.

I would strongly recommend that you have a talk with your 10 yr old. As a sprint employee, we get more calls than not of customer's underage children making changes to their parent's account online, ordering equipment online, or using phones registered to their parent's name to download or use the internet and then to have the parent call and complain to us! Like it's our fault that your child has done this. We cannot control what your child does, that is your responsibility.
