Staples Remanufactured vs. New Branson Missouri

I bought a HP-8250 ink jet printer from Staples in 2008, currently out of return period and warranty period. I have had ongoing paper jam issues since I bought it, since they were intermittent it was hard to pin done, as well as printing problems.

Now I don't know if this is the issue, but from my experience with Xerox (I worked for Canon for 25 years)these things go on in the printer/copier industry. I bought the printer as new, paid a new price, and low and behold I find a sticker today, after the 30th jam, on the bottom that says "remanufactured".

Now I know that can mean a lot of things, 1) It was returned, unhappy customer, 2) it was returned happy customer, need money. 3) It was returned broken, and fixed 4) and it was returned broken no problem found and not fixed put out as remanufactured. 5) It was returned reboed (reboxed) by H.P. and sent out as new no matter what. Oh yes in some states it can be repaired with used parts and called newly remanufactred to manufacturer specs.

My take is new is new, used is used and remanufactured is bought, returned for some reason, mystical hands waved over the product and deceivedly sold as new, maybe even Staples got took. I am angry and nothing will or can be done except this. Go figure.

If you have your original receipt you can do something about it.

CIVIL SUIT. In almost all (if not all) US jurisdictions it is illegal to sell something as new if it indeed was previously sold to a consumer and used (unopened OEM packaging excluded.)

Now, if you paid the retail price for a new item you probably can recover the difference and any statutory damages in civil court.

If you paid a DISCOUNTED price you might have some trouble. It would depend on the reason for the price discount.
