Stubhub, Inc Stubhub Bait and Switch + Fraud, Purchased lower level event tickets but received upper level seating New York New York

On June 19, 2023 Stubhub engaged in a bait and switch scheme where I purchased 2 lower level tickets for $248.40 and received 2 upper level tickets (which were selling for as low as $60). After I had scanned the tickets at the event, I realized that I did not receive the tickets that I had purchased. Stubhub offered a 25% refund initially and after a 50 minute phone conversation going back and forth and while I was at the event, the Stubhub customer service rep offered a 50% refund. Given up and to that point, I missed over an 1hr of the event while I was on the phone with the rep, I shared that the 50% refund would work for the time being. 

Even with 50% refund of my tickets ($124.20), it would have been cheaper for me to buy the upper level tickets out-right for $60. However, that is a separate issue because I would have not have attended the event if only upper-level tickets were available.

To make matters worse, even after I had purchased the tickets and received email confirmation that I would receive the ticket prior to the event, Stubhub continued to list the tickets, which Stubhub eventually found a buyer that paid $557.95, which is more than what I had paid. Continuing to list the tickets to other buyers, after I had purchased them is unethical, is deceitful and may be illegal, since I had already contracted to buy the tickets, which I already paid for.

In an effort, to remedy the situation I asked Stubhub to refund me my original purchase and then cover other costs event related costs such as parking. As of now, Stubhub has ignored me.

In addition, per StubHub’s FanProtect Guarantee ‘tickets will be the same as or comparable to those you ordered’ were company misrepresentations.
