My husband and I honeymooned in Cancun, Mexico where we were talked in to attending a presentation of a hotel other than the one we were staying in. We went and ended up being talked in to buying timeshare after six hours of relentless sales pitches and free drinks. We changed our minds and brought written notification of our cancellation to the company as instructed in the contract. We were told that we had rescinded our right to the five day "cooling off" period, but they would not give us a copy of that rescession. (This is because it is illegal to get someone to rescind their right to rescind.) We told the salesman we wanted to cancel anyway and was told okay. I kept a copy of the cancellation letter and left the original with the sales staff.

Upon returning home I had to cancel my bank card after we were charged $800.00 by Sunset Group. Now, I am recieving phone calls from representatives of the company in Miami. I faxed a copy of the recession letter, but was told that the original was not in my file. I was told by this representative that the sales man probbablly tore it up so that he would still get his commission and that I would still be liable to the contract. I am trying to find out now where the burden of proof lies. Do I have to prove I gave them the letter or do they have to prove I didn't? My husband is deployed to Iraq and now I am stuck in this legal mess with Sunset group. My honeymoon will forever be shadowed by the stress associated with this group and their fraudulant practices.

Sunset Group, to date, still has not received a copy of this cancellation letter that Charity states she gave to our sales department while still in Cancun. We have requested it many times but she has refused to answer our calls or submit the corresponding information. Without this information, we had no other option but to take further actions since the member was not in compliance with the contract terms and conditions. Sunset Group did all we could to rectify this matter but without the cooperation of the member.

After not hearing anything from Sunset for some time, I had assumed that they knew that we had rescinded within 5 days and that due to improper actions by their sales staff that recession was not processed, as I had informed them. Today, however, I learned that they had placed a $9,000 claim on our credit report. I was advised to contact the reporting agency and file a dispute. I am in the process of disputing this claim and I will file a complaint with PROFECO, which is like the Mexican better business bureau. I still have my original contract stating that we have 5 days to rescind as well as a copy of our recession letter that was given to the sales team at Sunset Lagon in Cancun. Their failure to honor this recession is against ethical standards set by PROFECO and I will endeavor to correct this action through disputing the claim and contacting PROFECO immediatly.

Letter recieved from Sunset

I recieved a letter from Sunset Group this week stating that it had come to their attention that I was posting "false and disparaging comments" about their client on the internet and asked that I withdraw my posting or issue an "immediate retraction." I reread my posting and all of the things that I listed above are true. The only update that I have is that since I have posted this, they have stopped calling and harrassing me. As of the last time I checked, no claims had been made against my credit report by Sunset Group. If any claims are made they will be disputed.

I have not recieved any notification from Sunset that this matter has been resolved, but have also not recieved any further attempts at collection and, as stated above, have not found anything in my credit report from them. I have also never recieved the $800.00 that we paid the day of the sale which, according to the contract, should have been refunded.
