My account, up to the point I stop doing transactions becasue I found out of this illegal banking practices, was in positive balance. Today my account is -690.00 and keeps ticking due SunTrust don't freeze so they can keep collecting NSF fees (creatred literally by them.

I've tried to talk to Bank represnetatives (they just respond as robots it is my fault about the NSF charged), e-care (online help, they respond a week later requesting to sign in securely and sending the message again. Branch manager in South Orlando branch, (lisa Santana)never return my calls. The assitant manager treated me in a very sarcastic way and did not take a bit of a look to my check book activity, practically she told me I do not know basic mathematics.

The first NSF fees were illegal as I had cash in my account. They just explained to me that it seems strange as a $900 deposit I made the day I was charged the NSF fees was in the morning and that as it was cash brough before the trasactions were posted at midnight, my accout to a ++ balance plus.

They explained that it is SunTrust policy to pay the highest amount first, in where they did not pay the highest amount, the same day I made a $900 deposit (i have proof of all transactions dates) It was a cashier's check, they made that afternoon. This policy causes people to pay more NSF fees for smaller amounts, meaning that if you have 10 $4.00 check card transaction in restaurants and 1 check for $1,200.00 and a blanace of $1,200.00 regardless of a chronological order, they will pay first the $1,200.00 then charge you 10 times $32.00 per NSF, what convinient for the bank. Besides they do not tell you this when you open an account with them, I can tell how well trained and how often this happens due they tell you this as if they know new clients will come and complaint about this practices.

Here is my first inquire in SunTrust e-care, which I ahve not receive either a folowo up or anyone has tried to help me in solveing the situtation, this adversely will have a bad inpact in my credit report, however if that happens I will be more than happy to hire lawyers and fight this issue.

First,

When opening my business account (IGENTECH, INC) "REPRESENTATIVE (MAXIMO
ALYALA) DID NOT TELL ME ABOUT HOLDING DEPOSITS FOR 10 DAYS BECAUSE ACCOUNT WAS NEW". I STILL HAVE A 3090.90 HOLD which is necessary for my business, the check already cleared (the issuing party). IGENTECH, INC.

Second, on my personal account, I am not sure, but seems to be that your (items on hold/pending) work in your systems as (items paid). I can send a scan copy of my check book activity, including a (printed check card activity by Amanda Ferguson, AVP Banking Office Manager, Orlando, FL) which is the only person which really tried to help me, however she sent me back to the branch where I open my account. Manager wasn't there (Lisa Celentano) Assistant Manager attended me in a very cynical way and didn't even look at my check book log. I am sending all this information to you by mail (ON YOUR OPINION COUNTS.

The printed check card activity matches closely my check book records and there are about 8 NSF fees which are unfair.

If you are able to help I will be happy to send or fax a scanned copy of my check book and the copy of the check card activity, Here is the activity (logged in my check book which matches your check card activity) since March 01 and running balance:

I did not logged charges on the 16th of March of 2005 and so on. As I am extremely disappointed, I am closing both accounts as soon as this matter is resolved. Hopefully your team is more receptive than on all the branches I went to show this.

YES, THATS RIGHT IT ALSO HAPPENED TO ME, I MADE A 1500.00 DEPOSIT LAST WEEK AND YES, WHEN I OPENED MY ACCOUNT I WAS NEVER TOLD ABOUT THE "NEW CUSTOMER" POLICY 10 DAY HOLD ORDEAL, AND WHAT AN ORDEAL! THEY CHARGED ME 300.00 IN NSF FEES, I CALLED AND TRIED TO GET RESOLUTION, TO NO AVAIL, I'M REALLY ANGRY BECAUSE I AM DISABLED MY DISABILITY CHECK GETS DIRECT DEPOSITED, I WAS JUST RECENTLY IN A MOTORCYCLE ACCIDENT WHICH LEFT MYSELF AND MY HUSBAND DISABLED EVEN MORE TEMPORAIRLY WITH BROKEN LEGS, AND I ALSO JUST HAD A HEART ATTACK FROM A DIRECT RESULT OF THE BIKE WRECK ( A BLOOD CLOT TRAVELED TO MY HEART FROM THE INJURY) WHICH WE ARE CURRENTLY IN THE MIDDLE OF A LAW SUIT AGAINST THE DEFENDANT FOR REAR ENDING US, AND NOT YIELDING TO THE RIGHT AWAY OF A EMERGENCY VEHICLE. THE FELLOW I USUALLY DEAL WITH AT THE BANK KNOW WE STAND TO GAIN ANYWHERE FROM A MILLION AND A HALF TO 3 MILLION, I EXPLAINED THAT IF THE FEES WERE NOT PLACED BACK INTO MY ACCOUNT THAT WHEN MY SUIT SETTLES I WILL GO ELSE WHERE, THEY GAVE ME ONLY A 36.00 CREDIT. THE 1500.00 WAS RESTITUTION FOR THE WRECKED BIKE FROM THE INSURANCE AGENCY, I EVEN CALLED THE BANK THAT ISSUED THE CHECKS AND WAS TOLD MY BANK (sUNTRUST) RECIEVED THE FUNDS IN THE ACCOUNT THE NEXT DAY AFTER I MADE THE DEPOSIT. HOW CAN THEY GET AWAY WITH THAT LEGALLY? THE FUNDS WERE DEPOSITED ON THE TENTH CLEARED THE ACCOUNT ON THE ELEVENTH, AND THEY HAD A HOLD ON MY ACCOUNT UNTIL THE SEVENTEENTH, GUESS THEY NOT ONLY TOOK 300.00 FROM ME BUT MADE INTEREST ON IT AS WELL! GO FIGURE!!!! SO NEEDLESS TO SAY I CALLED SOCIAL SECURITY STOPPED THE DIRECT DEPOSIT AND WILL BE LOOKING FOR ANOTHER ACCOUNT ELSE WHERE, WHEN I FIND THE NEW ACCOUNT I WILL PLACE MOST OF MY FUNDS IN THE NEW ACCOUNT AND LEAVE JUST ENOUGH IN SUNTRUST TO KEEP FROM BEING CHARGED A FEE, UNTIL I CAN EVENTUALLY CLOSE THE ACCOUNT.

OH AND ABOUT THE DEBIT CARD ISSUE AND THAT THEY TAKE THE LARGER AMOUNTS FIRST, AND THEN THE SMALLER AMOUNTS AFTWARDS? I REALLY LOOK AT IT THIS WAY THOSE CARDS ARE A SCAM WITH ANY BANK, IN ORDER TO USE THE CARD AN THE TRANSACTION TO GO THROUGH REQUIRES A "APPROVAL" CODE, AND WHEN THERE ISNT ANY MONEY OR ENOUGH MONEY IN THE ACCOUNT WHY DO THEY KEEP ALLOWING THE TRANACTION TO GO THROUGH? AND APPROVE THE TRANSACTION?
I THINK IF THE BANK IS GOING TO AUTHORIZE AN APPROVAL THEY SHOULD BE THE ONES RESPONSIBLE FOR ANYTHING THEY "APPROVE" RIGHT? JUST GOES TO SHOW, JUST ANOTHER SCAM FOR THEM TO TAKE OUR MONEY

Arnold,

This is a common problem with many people posting rip off reports angainst banks regarding NSF fees.

Debits against your account are always processes before credits to your account. Therefore, if you had the money in your account AND available, the order of checks presented means nothing.

The problem is, that people think as soon as they deposit an item it is available to spend, and this is not the case. Especially if you are using a debit card with your PIN#. That transaction posts against your account almost immediately.

**Here is a hint to avoid this problem**
When you make a deposit, DO NOT write it in your checkbook until you see it has posted and is available. Just put the reciept in your checkbook as a reminder to check it and post it. Also, deduct any monthly fees ahead of time, and deduct any atm fees immediately.

I think your case is another of just depending on the ATM to determine your "available" balance.

The bank has done nothing illegal here, and these posting policies are clearly spelled out in your account agreement, as they are required by federal law.

As a prior post noted, these terms were in the disclosures issued when you opened the account. I dpn't work for Sun Trust, but I get so sick and tired of folks who won't accept any responsibility for their actions (or inactions,)

Also, many banks pay the highest dollar item first because it is thought that it moght be yout mortgage, rent, or car payment and is assumed these are the most important items to you.

As a current customer and ex-employee of SunTrust Bank. I feel your frustration, many companies from banks, credit card companies, restaurants, and even universities are betting that you don't read the fine print. In the Georgia branch I worked at, I'm pretty sure we told them of the wait period for new accounts. I think was wrong of them not to tell you that. Our managers ran a tight ship. It was pretty obvious not everyone was following the book because we would get people wanting us to behave the lax way people had before. The wait period is crucial and is what probably caused all of this nonsense. I am having trouble following your timeline, however. For privacy issues, don't respond, but look at the information.
1. Date account opened
2. Date you spent money
If the time period between 1 & 2 is more than 10 days, you might have a solid case. If not . . .

Upon reading your posing again, did you write a check from your business to your personal or vice versa? People often thought money between SunTrust accounts were good. Not so. I thought it was stupid, but that's how banking works. Makes me want to barter.

I wish I would have found out about rip off report earlier so I could help you, but I would suggest you don't close your accounts. There will be fee. Always document every interaction with a SunTrust employee. We got secret shoppers all the time. SunTrust is pretty conservative compared to other institution. Try WAMU for completely different banking experience. I haven't tried looking yet, but most financial institution might have a rip off report of some kind. (I am refraining from my banking and cell soapbox. Companies that charge an arm and a leg to sell you storage space and air!)

I am sorry for the kind of customer service you received, but their own employees don't get treated well on internal phone lines. I think it comes down to branches and how they are run. There are good ones and bad ones.
**Cashier's Check is still a check. We as tellers were told that explicitly. It just means that someone other than you has verified funds, but they could be lying as well.**

I hope you find peace. In the future, I would open an account two weeks before you need to draw on funds in that account. If you need it sooner, do a money order. If the amount is too great, work something out with the person wanting money.

How many times am I gonna have to say this. CASH means CASH. It doesn't mean cashier's checks. It don't mean money orders. It doesn't mean postal money orders. It means cash. " The first NSF fees were illegal as I had "cash" in my account...". They explained to me that it was strange as a $900 deposit... "I made a $900 deposit(I have the proof)IT WAS A CASHIER'S CHECK. What part of cash don't you understand? Thousands of counterfeit cashier's checks are passed it day. How many posts are on this site from people who have received bogus cashier's checks and then sent the people back a portion of the funds only to find out the checks were no good?

If you read the disclaimer that was given to you when you opened the account you would be aware that the checks are put in largest first on the day presented. All banks have this policy and the reason they give is that these are most likely rent and mortgage checks. Why do you write a check for your balance when you have to be aware of the other charges out there you moron?
You brought this on yourself and the same thing or worse will happen at any bank you are with.

Again you want the bank to cover you when you overdraft so that you can be dumb and happy and make them give you in essence a free loan for carrying you.

Because of the way you seem to handle money I hope the company I work for never has the opportunity to do business with you.
