I just received an alarming mailing telling me I owe $1341.00 to T-Mobile. Considering I am quite sure I do not owe any money to T-Mobile, I online searched this company and another complaint about them came up on ripoffreport.com. I'm concerned that this is a scam which is exactly what I said when I left them a message warning them I will be very interested in pursuing a lawsuit regarding their fraudulent mailings/solicitation for money. I'm sure they think that people will not want to bother with a collection agency, so they will just pay. I have requested the credit bureau's to investigate and they did and I am now contacting the Attorney General to file a claim against them for not verifying this information with documentation. This is truly not my account.

Edna,

You will get nowhere in dealing with these lowlife. They will not respond to you at all except for more harassment over the alleged debt.. I have dealt with them.

The scary part is that would have to have your SS# to be able to report this on your credit.

If you truly know nothing about this debt, I would file fraud reports with the FTC and each credit bureau. Get a police report too.

Just to properly document your lawsuit, send a DEBT VALIDATION request. Send this by certified mail, return reciept requested. be sure to put the certified# on the letter itself, and keep a copy for your records. This is very important as it proves exactly what you sent.

In this letter, clearly dispute this debt, and demand to see the signed contract that created it. Also demand a full account history and itemization of all charges.

Also demand proof that they have the legal right to collect it and if they own it demand a copy of the sale contract/chain of title as well as proof of payment and amount paid.

Also demand that all negative entries be removed from your credit reports immediately and inform them that failure to do so will result in an immediate lawsuit.

Once they recieve this request, they must answer it or cease collections. If they continue to contact you after refusing to answer, it is both harassment and fraud.

Notify the postal inspectors as to the use of the US Mail to perpetrate this fraud.

Now, by the means above, dispute to the credit bureaus, and demand under the provisions of the FCRA that you get copies of all communications used in their "verification" process.

If they fail to respond as required by law, then you have grounds to sue them and win too. Federal law is 30 days prove or remove.

Don't get mad, get paid!
