I had my son tested at Sylvan Learning Center last year. When I contacted the Center, I was told it would cost $150 for Lifetime testing. I have the paperwork that shows I have paid for the lifetime testing availability. This past May I contacted the center for my sons annual test which should cost me nothing. I was told the owner would call me. The owner tells me that he did tell me last year that for a one time fee of $150 he would test my son every year, however, this was too expensive for him and he was not making money on the deal so he would no longer honor this deal.

I told him I felt this was breach of contract and he said "he was sorry I felt that way but he would not test my son again with out another $150". He said I did not go on to use his tutoring service the year before and he felt I was just using his testing resources. Sylvan tried to get me into a contract for tutoring that would of cost several thousand dollar for the one summer. I found a private tutor for considerably less.

I have the contract that says I am entitled to testing at no further cost and I am not getting the testing. The Sylvan owner said this is at his discression to change contracts and that he owns the center. So I guess thats just tough luck for me and my son.

It sounds to me as though you have a perfectly valid and enforceable contract. I would verify/check with a lawyer and take the owner to small claims court for either the lifetime testing or your money back. Good luck.
