Syncom And A Ms. Rivas Kept calling after our lawyer told them to cease Houston Texas
in 2005. my wife purchased a car from Autoway Honda in Clearwater, FL. Less than a month later she returned the car as it was a lemon. Shortly afterwards, we started getting collection calls from Triad. After contacting our lawyer who is representing us in a lawsuit against the dealership they calls stopped.
Now we are getting calls from Syncom who has taken over for Triad. The agent who keeps calling, a Ms. Rivas, has IGNORED two cease and desist calls from our lawyer and she keeps calling. Right now she is going to be personally sued for violating the Fair Credit Act. Evidently Ms. Rivas and Syncom think they are above the law.

I hate to say it but, evidently, your lawyer needs some education in FDCPA law.
The FDCPA DOES permit an alleged debtor to demand that a third party collector cease and desist further communications. However, such request must be IN WRITING. Further, if it is being sent by your lawyer, your lawyer is going to have to submit, along with the C&D letter, a signed and notarized statement to the effect that she has power of attorney regarding this matter.
So hold off on the FDCPA claim for now, because it's frivolous. Have your lawer read up on the FDCPA a little more closely, and go from there.
