Complaint Review: T-Mobile

T-Mobile $200 termination fee charged incorrectly and not according to contract. Rip-off! Albuquerque New Mexico

My T-Mobile contract says that I owed T-Mobile $200 "Termination Fee" if I cancelled my service within 12 months. 12 months was up a long time ago, and I just cancelled my service to go with a better deal from Alltel. Now T-Mobile wants a $200 termination fee from me, because they said, since they replaced my old phone, which would not hold a battery charge, with a different phone that worked better, that I needed to keep the new phone another 12 months, and I have only had it 8 months.

Well, the contract says nothing about $200 termination fee for 12 months after phone replacement.
In fact, when I called to cancel my account with T-Mobile I asked them what was involved in closing the account: what were all the charges, did I have to mail my phone back, or whatever. They said I would only be billed for pro-rated usage on my account for the last month of service. Nobody said anything about a $200 termination fee either when I ordered the replacement phone or when I stopped my service, even though I specifically asked about the charges!

So... I'M NOT PAYING THIS $200! I DO NOT CARE about their threats to my credit report or their collection agencies or other nonsense. Furthermore, I will begin BILLING T-MOBILE for my time spent as follows: repudiating fraudulent charges $100 per hour with a 2 hour minimum. I will apply the charge and bill T-Mobile whenever I have to deal with any more of their threats.
I have already notified them of this in writing.
