T MOBILE defective phone under warranty not serviced!! Internet US

In September 2006 I signed a 1 year contract with TMobile wireless. I chose a free phone, the Motorola V330. First of all I have to say that I have never dropped so many calls since I have been with them.

However this is not the main problem in January 2007 my phone started acting weird: it would turn off during calls or I would flip the phone open to enter a phone number and the screen would go white and freeze and I'd have to turn it off and on again.

I called the TMobile customer service line and the lady I talked with told me that probably it was the battery. I asked her if she could send me a new battery and she replied that that particular battery had a 3 month warranty and of course the warranty had just expired. A new battery would cost me over $40.00 at the TMobile website!! And once opened I couldn't return it!

During the phone call she informed me that my cell phone was covered by a 1 year warranty that would expire in September 2007.When I asked to get my phone replaced she replied that that particular model has been discontinued and no longer serviced by TMobile and she proceeded with giving me the Motorola phone number and told me that I needed to deal with them directly.

I travel very much and I need my cell phone for personal and business reasons and I am very upset when a company doesn't stand behind the products they sell.
