Back in January 2002, a very persistent salesman from Takemeon vacation bullied us into paying a deposit on two holidays for our family of seven to go to a two week holiday in Florida and a free week in Bali.

We paid 679.16 deposit. However, the paperwork that followed did not tally with what we had been told on the phone, namely we had been told we had two years to book our vacation (and save up for flights) we had also refused the cruise and just wanted the full two weeks in Florida which on the phone we were told we could have. The paperwork showed that we would be going on a cruise and that we had 18 months to book.

We phoned and complained and were told that what we had been told on the phone originally was still correct and that they would send further paperwork through with the correct details. It never arrived.

Having studied flight prices and wondering whether, if we arrived with our five children, there would actually be a hotel for us to stay in; we emailed a signed letter cancelling our package (we have made no reservations and therefore inconvenienced no-one) and asked for our deposit back.

The return email from Customer Services at TakemeonVacation refused us our money back and referred us to the small print which states that the deposit was non-refundable. At no time on the phone were we told that our deposit was not refundable and since we had no paperwork at that time how could we have read the small print. In fact the paperwork did not arrive until a month after we had paid our deposit

Help!! Does anyone know how we can get our money back? Or has anyone actually been on holiday with this company and found everything to be alright when they got there?

You had the free choice of saying "yes" or "no" to a total stranger for a legal contract that you were certainly unable to read prior to making that decision.

You said "yes" to accepting the terms of that unseen binding contract and, unfortunately, that makes "you" responsible for "your" difficulties.
