I PURCHASED A BRAND NEW TANK SCOUT JIANSHE 400U ATV OFF "SEVENLOTUSIC" (EBAY SELLER NAME FOR TANK-SPORTS) ON NOVEMBER 5TH 2009. THIS ATV APPEARED TO BE A GREAT DEAL AT $2600 SHIPPED TO ME. I finally recieved the atv on Novemebr 16th. I remeoved it from the shipping crate only to find a bunch of broken and defective parts on the atv. I notified Jim at Tank Sports and he assured me that things would be straightened out and they would take care of me. I sent pictures of the defective items which included a cracked cylinder head heat sink, broken control switches, broken light lenses all around the atv and a broken fuel switch. So a few weeks go by and still no parts. Now I have noticed that a boot and seal have broken and are leaking on the rear differential of the atv so I report these problems. Jim still assures me that these things were being taken care of and he was on top of it. After about a month of no resolution I am getting aggrivated and threaten to use legal action. A few days later I recieve an email with a picture of the shipping label from Tank-Sports. 7 days later I recieve the box finally to open it up to broken lenses, stripped screws all of which were replacement parts removed from a used atv. I am extremely annoyed now. I was also promised the seals, boot and a replacement cylinder head all of which were not sent. I am going to copy and paste my emails from tank sports so you can see the promises that were broken one after each other from the point I did business with this company.
I am going to include the emails from this company from before I recieved more junk in the mail from them

I will also be needing the 2 boots on the front of the swing arm that connect the drive shaft tube to the transmission/engine. The front one is completely ripped as seen in the pictures and the rear one appears to be dry rotted already. I'll replace the pinion sea/boots and adjust the clutch in my shop but we are talking quite a bit of labor to do all this work and have to adjust the clutches already. This really starting to bug me. You company is really lucky I am a licensed mechanic. I feel taken advantage of just a bit. What would you of done if I was just your average customer who had no mechanical knowledge? To adjust the clutches and replace the differential pinion seal is probably $500-800 worth of work at any motorsports dealership. Can I be compensated for any of my time and labor or is that just expected of me for purchasing this atv? I don't mean to sound rude but come on, 76 miles and I'm already turning the wrench on it, still waiting for my parts and haven't recieved any partial refund at all... I'm so aggrivated right now I am considering putting the atv for sale once I replace all the defective parts, repair the rear end leak and clutch slipping. It looks like the seal was leaking from the rear end differential down the tube/shaft into the front boot. I went to strap the quad down on the trailer today and when I compressed the suspension to secure the quad I heard a pop and found about a 1/4 of a quart of gear lube below the boot on the trailer. The boot must of been loaded up with gear oil from the pinion seal leak and blew open, leaking fluid everywhere. I am not 100% positive that the pinion seal is what's wrong but it's a good posibility. I also noticed that when I ride the atv that the transmission revs in different gear and at different speeds instead of gripping the gears and accelerating smoothly. Seems like I am letting off the throttle quite a bit to allow the engine speed to keep up with the transmission. I've attached pictures of the cracked boot leaking gear lube and have absolutely no idea what could be wrong with the transmission. I'm just so aggrivated right now. I woke up at 7am this morning to meet some people to ride, loaded the quad, noticed the leak, put the atv back in the garage and went back to bed. Starting to get tired of the issues. I've only had the atv 3 weeks and have had nothing but problems. I've only done light riding with my 5 year old nephew too and it's already breaking. His little 110cc Tao Tao atv has held up better than this one for $2600. I am staring to think I should of bought a used name brand atv for the money and would of been better off or spent and extra $1500 to buy brand new from a local dealer. Let me know what the next step is please. I'm really getting sick of wasting all my time fooling with this atv. I've spent just as much time addressing problems than I have riding it probably. I should be able to get on it and go without all this hassle.Mark

as for the parts, we will be sending out the parts sometime today.
as for the engine, it is certain that the engine was not dropped. the mfg would not install and engine that was dropped. the fins on the engine do chip from time to time. sometimes they are dinged when it is being lowered into the frame or from the engines hoised up on chains for installation. fins gets chips from riding also when pebbles hits the fins. out of the units that we have sold in the past on or off the internet, we have not had a defective engine due to an engine drop, neither have we seen a chipped fin on the 400u. prior email you have stated that the engine seems to perform well without issues, that leads me to conclude that the engine was not dropped. but even thou i am very certain that the engine is good, i will include a cylinder head for you as you have requested.
as for the prices, thats something that we can't really do anything for you. You purchased the vehicle with the buy it now option, we can not offer you discounts.
as for the resale value, i can't really help you on that one either, ATV goes though a lot more wear and tear than other products because of their intended usage. i am not an expert in resale value but based on looking at cycle trader magazine, the 2nd hand price for ATV has always been lower compared to the street bikes.
As for the $50 discount, it only applies to the cosmetic damage to the heat fins.

as for the chip on the fin, the tech said that its visual, the chip will not impact your engine. he recommended getting the sharp edges filed down to avoid any scrapes. i spoke with James and he wants to offer you a $50 credit back for all the issue and for filing down the sharp edges. After months of waiting today a USED cylinder head arrives from Tank Sports. I don't know if I should be happy or mad. It's used and who knows if it is any good. I was so shocked I even recieved the part. Once again I get one that is damaged. I have no clue why they waste their shipping money. All I can do is laugh now. I have no anger left inside me. Now just waiting for the clutch, lenses, controls, boots, seals ect... Looks like Motor Vehicle gave them the nudge they needed to get rolling or maybe Jim had no excuses left for me.

I would like to correct my last post. I stated that the Tank-Sports website advertises the ATV to be 495 lb. I made a mistake it is actually 595.2 lbs and the Cerificate of Origin states it weighs 300lbs. Big Difference!!

I called ebay yesterday and filed a complaint with them. After chasing Tank-Sports for answers for weeks and weeks. This is how they respond to the ebay claim. I left it to the EBAY representative to straighten this out and hopefully they can make the right desicion for me.

Are they in the factory every minute, and know this for sure?
I taught English at an electronics factory in China. I had to walk through the packaging warehouse on my way in one time, because they were repairing the main door. Right in front of me, someone dropped 20 or so DVD players off a conveyor belt. It was about a 6 foot drop. A few of them lost the face plating. I had a birds eye view of the packaging department, from my classroom. I watched for about 15 minutes to see what they would do. They picked them up and stacked them. Broken display covers were thrown out. Someone came a few minutes later with a handful of small plastic transparents. Right there, they snapped on new covers, then put them all in boxes without even testing to see if they had broken any of them.

This is not intended to be any kind of criticism of you. I would be as upset as you are.
It is, however, a good lesson for other people. Don't buy something like this sight unseen. It SHOULD be safe to buy something new this way but obviously it's not. Buy it locally and buy the exact one you see at a dealer, not one they order and ship in. If it's not local, either travel to look at the exact machine and be prepared to take it with you, maybe even take someone with you who has in depth knowledge. OR don't buy it.
Even with all this you could get a lemon but at least your chances are greatly improved.
