She lost key to her car. She called us out to make her a new key. After explaining to her on the phone BEFORE we came out that we did not accept personal checks she presented a check to us for payment. We accepted the check and the check came by with ACCOUNT CLOSED!! Called woman up on phone and she hung up on us. Persuing through court action.

You have a policy and informed the "customer" of it. NO PERSONAL CHECKS. And then you accept one. It bounces. SURPRISE!! This is the reason you made the policy in the first place. I personally would not, and do not take checks from people I don't know without calling the local bank it's written against and verifying the money is in the account. If it is, I ask the bank to put a HOLD on that amount and give them the check number. If the money is not there, I tell the customer to bring me cash, no credit card, no money order.

I figure if they are willing to pass me a rubber check, I am willing to hold onto their car until they make good on the bill. And no, there is no law anywhere that requires me to take any form of payment I do not want to take. I'd suggest framing the check and hanging it on the wall next to the NO CHECKS sign. If anyone asks, that's the reason for the policy. I did it once. The person got embarrassed by it(all her friends and neighbors used my shop too) and tried to make good on the check. She paid about 1/2 of it and then moved. I got some of it, and learned my lesson. good luck.
