This police department violated the law by encouraging my former 5 time evicted court documented mental patient roommate to file complaints about me.

I was on the lease for 3 years. The main lease holder moved out leaving me with a mentally ill roommate who was hell bent on getting the entire lease to a tremendous deal on a 3 bedroom flat with a backyard and garage for $1,200 in 1999. It was an incredible deal in a tight housing market in San Francisco. My rent was low and I wanted to hold on to it as long as I could to save money.

This roommate filed for Chapter 13 the day she moved in with us. I was there first. I had excellent tenant references. The main tenant was Betty Fairchild, a famous author whose two roommates had left her with two empty rooms. We did not know the roommate's history, but it was serious. She had been kicked out of the Progress Foundation's mental health housing project and accused the counselors of harassing her there. They couldn't handle this woman. Then the mental patient lived an entire year at the Mary Beth Inn without paying rent prior to moving in with me and Betty Fairchild.

It was like something out of the movie Pacific Heights. The evictee knew the legal system, knew the game. In fact, she demanded two court trials for her legal evictions. "Religious Society of Friends" even had evicted her.

As in the film Pacific Heights, after Ms. Fairchild moved out, this mental patient would call the police on me about everything from missing rags and light bulbs, to the smell of sulfer that came when I put chemicals in my fish aquarium. She referred to it as "body odor" in her legal case filed against me. Ms. Pacific Heights was planning on filing a civil suit for damages against me until her attorney saw her case history.

The police came onto the property, first to give me a ticket for assault, claiming there was a "welt" on Ms. Pacific Heights face. She took a photo of her own face as her only evidence. She had no witnesses. I had argued with her about her moving my property around regarding space issues.

One would think the police would be able to easily establish which one the nut case was, not these officers! They enjoyed the victimization of me because she was an African American and they didn't agree with our living together. So, they were enjoying victimizing me with this woman. Often they were brought onto the property to write up reports on roommate messes, without my knowledge.

This lady felt completley free to harrass me, block my entry, try and prevent my moving in a fish aquarium by calling the police. One day she called Officer Ronald Gerke who she had spoken with about me previously. He came over within minutes of her call, huffing and puffing, angry looking like he wanted to kick my but. He said "who do you think you are?" for moving over her exercise equipment so I could get my large aquarium in the hall way. He stayed on the property fully on the side of this mental patient nutcase, for 30 minutes when absolutely nothing had happened! All I was doing was moving in my fish aquarium.

I filed a second complaint on this police department, this officer had said as he sat in my kitchen monitoring me, that he had "all the time in the world" (1999). That was clear from the evidence of the 20 police reports these idiots wrote up on me, most of which were written without my knowledge!

This police officer also spoke with other tenants on the property about me over some dispute with the storage room lock. It busted and I bought a new one to replace it. Nothing was valuable in there. I paid for the new lock myself and gave them the keys. This cop was curious about that!

There was never any evidence of this wacko's "welt" other than the police report that caused me $2,000 in legal fees. I was employed at Morrison & Foerster, LLP, my roommate was self-employed! The only thing she did was flash her student faculty teaching badge at them and spoke of me as if I was a 38 year old adolescent.

The police wrote so many false police reports against me, and violated the Constitution by coming onto my property to search it without my permission or knowledge (recently the Supreme Court ruled they cannot do this without both tenant's permission), and the only thing on my record at the time was a 7 year old reckless driving ticket that I performed community service on. I had no significant record at all. I was just a single woman and they wanted to believe my roommate's lies that I was a criminal element.

The police did so much work on behalf of the mental patient, that she was able to get a 3 foot restraining order. The day I moved, she was so "frightened" of me that she came outside to observe my move, monitoring the storage area that really wasn't her storage area so it shouldn't have concerned her (she had a huge garage for her storage area).

This lady took out a $90K student loan after her bankruptcy and acted like she had no history. It was like the guy in Pacific Heights, it really was. She was completley, totally victimizing me. The police had a lot of time on their hands, and worked on behalf of a criminal who ripped many landlords off, and who has no intentions on paying back her $90K student loan in her lifetime as she would be 60 when her first payment would be do.

The police basically chased me off of my leased property, where I had lived for 3 years without ever being late on rent. They never got my side of the story whenever they wrote up reports on alleged vandalism of my own property. They didn't care, they just wanted to help the criminal element get rid of her problem.

The police cost me a total of $4,000 for all of their mischief on my property. I once came home to find a huge sack of trash sitting on the property as it was clear it was deliberately put there by their department member to continue the victimization of me, as they knew I had performed community service for a reckless driving ticket and for "evading" a police officer who I had gone to high school with. The police were completely unprofessional, out of line and in the end they all partied with the criminal after I was harassed off of the property like a criminal.

The police at the Taraval station are a bunch of sickos who can't be trusted to do their jobs correctly. I had another experience where I spit out of my helmet one day. It didn't come anywhere near the car that was 100 feet away and I wasn't directly spitting at it. The police officer completely turned around and drove 1/2 mile down speeding, out of control with his lights on to stop me to ask me why I spit at him. I didn't complain about this time because I was tired of filing complaints against these Keystone cop idiots who side with criminals and look to victimize innocent people. These men are truly psychos at this police department.

I had another experience where a new co-worker I had shared my experiences with about this police department, tried to blackmail me into helping her break free of her grandfather. She was going to tell my employer about the restraining order I had in 1999, a major law firm! She spoke with the police officer involved in the case, and he made her hysterical about me! She put on a dramatic show on his behalf, in front of my employer, in order to try and get me fired. It didn't work. She was clearly the psycho and had forged a credit card application. These are the kind of people the police at the Taraval side with - criminals. It seems the criminals contact them, like in the movie Pacific Heights to victimize innocent people.

Today I have a new lease in a beautiful Nob Hill building and will not be having roommates ever again if I can help it.

1. After I lost the 3 foot restraining order case, I filed a complaint against my attorney because he failed to prepare for the case. He believed he could have the case thrown out on a technicality due to it being a roommate situation that the Commissioner rejected. He also failed to get the Plaintiff's 5 eviction cases properly submitted for the court's record so the Commissioner threw them out. The attorney is disbarred. I wasn't the only one who complained.

2. When I went to the mediation meeting with the roommate (my attorney had asked I attend this during one of the hearings), a former police officer was part of the mediation team and tried to hit on me on the way home. He accompanied me out of the building to my bus stop where he rode with me. He came up close to my face, violating my physical space and acted like he wanted a date.

Essentially, men set me up in this entire case because I was a single middle aged woman living with other women. They were trying to flush me out of my living situation where my privacy was completely violated (they behaved like rapists really). In the end I was hit up by a former police officer who wanted a date with me. He was wearing a leather jacket, cologne, he was all ready wanting to f**k me. I've been celibate for 20 years.

These men are sick and exist on the level of criminals disguised in the legal system they manipulate to their advantage. I saw through their little operation as nothing more than police family mischief. They dishonored their badges, and are a disgrace to their profession.

Consent to search among co-tenants

You stated above "The police . . . violated the Constitution by coming onto my property to search it without my permission or knowledge (recently the Supreme Court ruled they cannot do this without both tenant's permission)."

If it was without your knowledge, then your issue doesn't fall within the ruling to which you refer. The case is Georgia v. Randolph, and its opinion holds that, when both tenants are PRESENT and one objects, the police cannot use the permissive tenant's consent to justify the search over the objection of the non-permissive tenant.

But if you weren't there, then your roommate's consent was effective and allowed for the warrantless search. The case only applies when both tenants are present.

That's not to say that the rest of your report isn't valid, however.

1. Ms. Pacific Heights was planning on using the police reports against me as evidence in a civil suit for damages. She claimed she couldn't collect anything because I had no assets, but it was because her attorney saw her case history.

2. Ms. Pacific Heights talked to the police as if I was the mental patient, said I was unemployed, and bringing drug dealers on the property. I was working long hours at Morrison & Foerester where I had even gotten a promotion on their night staff shift. The alleged drug dealer was a physical therapy student I was helping with his Internet research.

3. Ms. Pacific Heights would use my dark, H20 seaweed body mud material she found in the bathroom we were sharing (imagine that!), and smeared it on the toilet to make it look like I had harassed her with s**t on the toilet. She took a photo of it and the police wrote up a report for her.

4. Ms. Pacific Heights got the police to write up police reports on my alleged vandalism of my own leased property! Claimed shoe polish was in the bathtub, dirt was on the carpet I had actually paid $500 to have replaced from water damage.

5. Called the police when I had to move her kitchen table furniture to the front patio area when the carpet was being replaced. There was no where else to put it for the carpenters to work and bring in their materials.

6. Took photos of the front area that had previous tenants material/trash, accusing me of messing up the area with my trash. I only put the recycled bottle container there for convenience. Included it in her restraining order.

7. During the mediation meeting the court requested during the hearing, Ms. Pacific Heights said that Officer Ronald Gerke told her he would write down anything she wanted him to.

8. When I was waiting outside the hearing room for the first appearance for the 3 foot restraining order, I overheard Ms. Pacific Heights attorney speaking on the phone describing how "upset" Office Ronald Gerke had been over my alleged abuse of Ms. Pacific Heights. Ms. Pacific Heights had a court documented history of complaining about being abused by professional conselors, even admitting yelling at them for their lack of attention, and being suicidal around the holidays.

This was a woman who didn't pay rent for an entire year at the Mary Beth Inn - $800/mo rent prior to moving in with us. They let her live on the property, out of their tolerance, and yet this lady wanted to unlawfully evict me out of revenge for her past problems in life. Then, try to file a civil lawsuit to collect mone from me! Imagine how evil a person is to do something so deceptive - she felt justified due to feeling her African American heritage gave her a right. She referred to herself on the hearing stand as a "genius" and a professional business woman.

Imagine a person so sick, to want to persecute people who were paying their rent on time, abusing police services all the while. Other people in real need are often complaining about the poor police service they get in San Francisco. Ronald Gerke said he had "all the time in the world" and would come back to my property in a threatening manner. That's when I filed a complaint against his little fish aquarium visit.

I evaluating how this police department behaved, I concluded they were being overly helpful to Ms. Pacific Heights due to my initial complaint about their false report there was a "welt" on this woman's face. There was no medical evidence whatsoever. The police lied and I had a right to complain. They were coming over to harass me due to my initial complaint.
