TBW committs 'FRAUD'..My husband and I purchased a home (unknowingly) by 'FRAUD' and TBW foreclosed on the home by 'FRAUD'..'KNOWING WITHOUT A SHADOW OF A DOUBT 'WE' HAD BECOME VICTIMS OF 'MORTGAGE FRAUD' FROM THE BEGINNING TO THE END!!'..'They don't care, because it is all about the 'almighty dollar' with TBW and their co-conspirators in Missouri!!'..You will read about Craig Robeson Weitzel/Fraud Manager for TBW..
The credits TBW has given Craig Weitzel is 'absolutely not true about his position with 'mortgage fraud'..'He represents FRAUD for TBW's clients!'..'Our 'sell contract' through Oakstar Bank out of Springfield, Missouri was sold to TBW'..'We were led to believe we had purchased a home (302 W. College St. Aurora, Mo.) that was at least a two bedroom, possibly three, that was built in the 1950's and with good floors'..Great Commission Realty/Gilbert 'Bud' Jones; Oakstar Bank; their (Mary Kym Craft a.k.a. Kym M. Craft) falsified listing documents, loan documents, and appraisal documents..
These people/companies including TBW were aware of this (didn't expect to get caught) and that the home in question was appraised originally as a three bedroom, built in the 1950's with good floors..'When in reality, proven, documented without a shadow of a doubt the home is a one bedroom and built in the late 1800's with severely damaged floors!!'..Infact the home is 'unliveable'..After many letters to TBW without any replies for months, it took stop paying the house payments for TBW/Craig Weitzel to contact 'us' via e-mail and phone..
Note: We paid the payments to salvage our once 'excellent credit' and also 'we' were trying to get someone to take over the loan..Not asking for any monies (well over $13,000's) invested into the home..Just someone to take over the loan..We had a couple of people interested, 'but' once they seen the inside/condition 'they' knew the home was greatly priced inflated, and the repairs would inflate the value even more..Mr. Weitzel contacted my husband and stated he was sending out an appraiser
..He sent (Cynthia Speckman's) report via regular mail..'Immediately I compared Miss Speckman's report to the original (Miss Craft's) appraisal report and 'both' were identical'..Mr. Weitzel and Miss Speckman, didn't expect to get caught, 'but they did!!'..So then Mr. Weitzel contacted my husband again, and stated he was sending out another appraiser..During that same conversation Mr. Weitzel asked my husband, 'what do you feel your damages should be?'..My husband replied, that 'he wanted the sell reversed like it never happened and our money back'..
Prior to the final and 'honest appraiser' (Samatha Balsamo) appraising the home, Mr. Weitzel told me on the phone, 'I bet the home comes back to at least a two bedroom'..He didn't take into regard the true age of the home or the condition as well..Well, the final and 'ONLY' honest appraisal by Miss Balsamo, came back as a 'one bedroom, built in the late 1800's early 1900's, severely damaged floors and 'unliveable'..
Mr. Weitzel/TBW, Oakstar Bank/Julie Barker; Great Commission Realty/Gilbert 'Bud' Jones as well as both bogus appraisers..Miss Craft and Miss Speckman 'did not like the findings!!'..The home came back to what my husband and I had stated since 2007..Mr. Weitzel stated he would get together with Oakstar Bank/Julie Barker and 'rectify the matter for us'..
TBW/Craig Weitzel backed out on 'their word' while Oakstar Bank/Julie Barker tried to justify that their appraiser, Mary Kym Craft/Kym M. Craft 'made a mistake when she appraised a parlor and enclosed front porch/sunroom as second and third bedrooms'..Oakstar, Miss Barker also tried to justify the wooden floors being severely warped/damaged..'Yet no one mentioned about the fact/truth also of the true age of the home'..
All the above names/companies would either try to justify, pass the buck around, pacify, intimidate, etc., instead of stepping up to the plate knowing for a 'fact, beyond a doubt' 'we' fell victims to them of 'mortgage fraud'..'BEYOND A DOUBT!!'..'WE WILL NOT STOP PERSUING THIS SERIOUS ILLEGAL MATTER UNTIL WE GET THE JUSTICE WE ARE SO LONG OVER-DUE!!!'..TBW 'foreclosed' on the home and now have it on the market, showing the listing as a much lower value, one bedroom and honest stipulations..

COMMON MORTGAGE FRAUD SCHEMES
Property is purchased, falsely appraised at a higher value.
What makes property illegal is that the appraisal information is fraudulent. The schemes typically involve one or more of the following: fraudulent appraisals, doctored loan documentation, inflating buyer income, etc. Kickbacks to buyers, investors, property/loan brokers, appraisers, title company employees are common in this scheme. A home worth $20,000 may be appraised for $80,000 or higher in this type of scheme.
Inflated Appraisals. The report inaccurately states an inflated property value.

Hi Shane..In my final reply to you.."Absolutely Shane there is no doubt that TBW's fraud manager Craig Weitzel hired Cynthia Speckman (second appraiser) to falsify her appraisal report by copying off the original appraisal (Kym Craft) false report.."Not realizing their scam backfired on them!!"..That is without a doubt and no problem proving..Why do you think Mr. Weitzel contacted my husband the following morning after we received Miss Speckmans report, and that same day she (Miss Speckman) basically admitted (via e-mail to me) she copied her report?..Mr. Weitzel contacted my husband, because Miss Speckman contacted Mr. Weitzel and basically let him know I discovered her report was too fraudulent..Plus the letter that was attached to Miss Speckmans report from Mr. Weitzel, is in our favor as well..Let me say this as well..An "oral agreement" is just as binding as a "written agreement"..On an "oral agreement" and/or "written agreement" taken into court, it is called "tipping the scale"..Who is more credible?..Plaintiff or Defendent?..With all the documents I have against Great Commission Realty/Gilbert "Bud" Jones..Kym Craft/Mary K. Craft..Oakstar Bank/Lisa Schupback and Julie Barker; "Ahh and lets not forget TBW a.k.a. Craig Robeson Weitzel and his bogus (Miss Speckman) appraiser as well"..Plus the only honest (Samatha Balsamo) appraiser is the icing on the cake.."Again no doubt; no brainer, hands down in our favor!".. "See, if a judge/jury seen all the documentations I have against these "parasites" and any of the above named opened their mouths, immediately the courts would agree, that the only thing missing from what any of them said is; "Once Upon A Time"..Note: In 1997 I appeared in good faith on a talk show that contacted me..I can't go into the details or mention the show as was part of the settlement they made..I appeared on the show via "oral agreement"..Then the show had me sign a "release paper" prior to appearing on stage..The topic of the show didn't appear..You see I was told the topic was one name, while this show decided to alter the name of the topic without my knowledge..Well lets just say two years down the road, and after going up against 7 high profile attorneys, and their dirt, the show was cancelled; everyone that was involved with deceiving/frauding me to appear on the show was fired and black balled, including the hostess..I had a Beverly Hills attorney that took the case "pro bono" and we sued for "breach of oral agreement" and "mental anquish" and the show settled out of court two weeks before we were to appear in a Los Angeles courtroom and covered by Court TV..I didn't sue for the money, but that is how our court system usually settles things..I sued to stop those that "frauded/deceived/breached" an agreement with me, wouldn't beable to do this to another quest.."I am proud to say this talk show was never able again to use another for their own selfish, greedy, ratings need!!!!!!!!!!!!".."Off the air they went for good!!"..One final note..Yes I have contacted Springfield, Missouri real estate attorneys" about this "mortgage fraud"..At the time our damages were what we were out of via "fraudulent sale" which wasn't enough for an attorney to take our case.."Now today you tack on "mental anquish" to "mortgage fraud" you are talking about major $$$$$$$$$$$ in compensation!"..One attorney actually complimented me after viewing my documents and stated, "I could take TBW and the others into court and win hands down just by my documentations and orally stating my case..I would need an attorney though to understand attorney talk"..No matter what it takes or how long it takes, "these parasites" yellow bellied, rotten, lieing, thieving cowards "will be held accountable for their illegal actions (mortage fraud & mental anquish) they chose to endure us too..They obviously didn't realize when they decided to "screw us" they went up against the wrong people.."They're just a bunch of snakes hiding under rocks!!"..Take Care..Don & Wanda Reed..

Well from the last step by step events you wrote out, it sounds like if any blame would be put on TBW, it'd be if the fraud manager worked with the 2nd appraiser to fraudulently produce an appraisal (by reproducing the 1st appraisal). You've said the 2nd appraiser admitted to copying the first appraisal, which I'm not positive but I'd think that'd be some sort violation of state appraising laws, but you didn't say if they were coerced by TBW's fraud manager to do it. If you don't have proof of that, then it's just your word against TBW's fraud manager's, and in that situation unless there is a repeated history of this sort of thing, odds are not good a neutral party will find in your favor.
The fraud manager asking your husband what he would like to happen doesn't admit fault, and unfortunately there'd be no way they could "undo" the sale (since that would involve the seller repurchasing his home back, good luck there). What could potentially be done is the home would be purchased back from you, or the mortgage would be forgiven. Since the home has been foreclosed on you at this point I imagine the only thing you could get at this point is perhaps punitive damages along with all of the actual costs you've incurred from this fiasco. If the events you say are true, then I could see your lawsuit against the originating lender, perhaps the real estate agent (depending on how the home was disclosed to you, verbal disclosure doesn't hold up well in court, written disclosure works excellent), and also the original appraiser.
However in the only way you are going to be able to get any of that is if you hire an attorney. The FBI, AG, Department of RE, Appraisal Board, etc. can all punish the violators, but do little to assist victims in recovering damages vs. what an attorney could do for you. I'm sure a real estate attorney in Aurora, MO would be particularly interested in helping you out. Have you contacted any attorneys to talk about your case?

Mr. Milne..While I appreciate your response, and does make alot of sense..Shows you are a very intelligent person.."What you don't seem to understand, is TBW should have went after Oakstar Bank/Julie Barker; their appraiser Miss Craft, and also Great Commission Realty/Gilbert "Bud" Jones, because even Craig Weitzel/fraud manager for TBW stated via phone that Oakstar Bank frauded them (TBW) as well as us"..Especially since Mr. Weitzel stated to both my husband and myself that if the home came back as a one bedroom, etc. that "he (Mr. Weitzel) would get together with Julie Barker/Oakstar Bank and "rectify this matter for us"..Mr. Weitzel even asked my husband via phone, "what do you feel your damages should be?"..My husband replied that "he (husband) wanted the sell reversed and our money back"..Miss Barker sent us an e-mail stating, "she was working on the situation for us"..She asked if she could call us and discuss about rectifing this matter..She and Mr. Weitzel led us to believe they were going to make this serious matter right, but instead on the phone Miss Barker tried to justify that her appraiser (Mary K. Craft/Kym M. Craft) "made a mistake when she appraised the home as she did"..The home being appraised as a three bedroom, and built in the 1950's..She nor Mr. Weitzel took into regard the true age of the home as well as the inside condition as well..To whereas she (Miss Craft) appraised it for $58,000's and was sold to us I believe for $54,000's..If TBW wasn't partially responsible for this, "why then did Mr. Weitzel ask my husband, what he felt (husband) his damages should be?..Why then when Mr. Weitzel and his first (Cynthia Speckman) get caught for falsifing her appraisal report by copying off of the original (Miss Craft's) false report, the following morning Mr. Weitzel called my husband and said he (TBW) was sending out another appraiser?"..Mr. Weitzel/TBW wouldn't have done that but Miss Speckman let him (Mr. Weitzel) know that I discovered her appraisal report too was fraudulent.. I have the e-mail of Miss Speckmans and my conversation, when I discovered her appraisal report was identical to Miss Craft's report..Miss Speckman became very upset and basically admitted she did copy her report..Now that appraiser was hired by TBW, and she (Miss Speckman) falsified her report..So TBW's first appraiser did exactly what Oakstar Bank's appraiser did.."Falsified the appraisal report"..That is the ONLY reason Mr. Weitzel contacted my husband the following morning and stated he was sending out another appraiser..Infact Mr. Weitzel even stated to me via phone, "I bet the home comes back to a two bedroom"..It took Miss Samatha Balsamo (second appraiser by TBW) to back up our claim, that we had stated since 2007..
Well when the home came back as the truth by Miss Balsamo, Miss Barker/Oakstar Bank stated via phone this wasn't "mortgage fraud" and Mr. Weitzel stopped all contact.."Mr.Weitzel promised that he/TBW would make this right, and yet he/TBW lied as the above names/companies (excluding Miss Balsamo) did."..My husband and I are the victims, and yet Oakstar Bank nor TBW will make it right..I reported Great Commission Realty/Gilbert "Bud" Jones to the Missouri Real Estate Commission, and provided proof..The Boards decision wasn't for or against us, but basically stated we needed to seek legal help..Then when we got the final appraisal; the honest appraisal from Miss Balsamo, I contacted the MREC again, requesting they reopen the case against Great Commission Realty and sent them (MREC) Miss Balsamo's appraisal report..I received a reply from the Board, that they weren't going to reopen the case..
I contacted Miss Barker/Oakstar Bank requesting Miss Craft's "insurance provider"..She refused to tell me, and forwarded my request via e-mail to Miss Craft..Miss Craft did not reply..I have contacted the FBI, Missouri Attorney General, Missouri Real Estate Commission, Missouri District Attorney, etc. etc. in Missouri..I then contacted the Mayor of Ocala, Florida, recently BBB, Mr. Lee Farkas, Ray Bowman, Attorney General in Florida, Mr. Bill Collum, newspapers, etc. etc.etc..You name them, I have contacted them, other then Governors and the President..I even sent forwards to Oakstar Bank/Julie Barker, Miss Craft, Great Commission Realty about my findings from the FBI on "mortgage fraud" that you sir read.."No responses!!"..All we wanted was to retire in the home of our dreams..Never expecting the home to be 100% perfect, but did expect and deserved 100% truth of the home, and "we never got it from beginning to the end"..
So TBW forecloses on the home without any regard to the circumstances, as well as they had it listed with Coldwell Banker-Vanguard..The listing with honest stipulations and showing as a one bedroom..First selling price in November 2008 at $37,790's..Then reduced in January 2009 at $32,000's..Then reduced again in January 2009 at $29,900's..I recently checked on Coldwell Banker-Vanguard's website on the home again, and it doesn't show the listing anymore..So assuming the home got sold at possibly even a lower price..So not only did we not get the home we were led to believing we purchased, but out alot of money put towards it..TBW forecloses, and puts a negative against our credit..Not to mention the physical, mental and financial my husband and I have been put through..Infact I am crying so hard right now, because I don't know how much more of this I can take..
People could have made this right, but greed got the best of them..It is a d**n shame that the all mighty dollar supercedes, the truth, dignity, intregity and more importantly honesty with greedy people/companies.."There are far more important things in this world then money..Called PEOPLE!!"..Called HONESTY!!"..Called DIGNITY!!"..Called INTREGITY!!"..Called PROMISES/GOOD FAITH!!" as well..Thank you again for your imput..Don & Wanda :o(

Craft/Kym M. Craft) "made a mistake when she appraised the home as she did"..The home being appraised as a three bedroom, and built in the 1950's..She nor Mr. Weitzel took into regard the true age of the home as well as the inside condition as well..To whereas she (Miss Craft) appraised it for $58,000's and was sold to us I believe for $54,000's..If TBW wasn't partially responsible for this, "why then did Mr. Weitzel ask my husband, what he felt (husband) his damages should be?..Why then when Mr. Weitzel and his first (Cynthia Speckman) get caught for falsifing her appraisal report by copying off of the original (Miss Craft's) false report, the following morning Mr. Weitzel called my husband and said he (TBW) was sending out another appraiser?"..Mr. Weitzel/TBW wouldn't have done that but Miss Speckman let him (Mr. Weitzel) know that I discovered her appraisal report too was fraudulent.. I have the e-mail of Miss Speckmans and my conversation, when I discovered her appraisal report was identical to Miss Craft's report..Miss Speckman became very upset and basically admitted she did copy her report..Now that appraiser was hired by TBW, and she (Miss Speckman) falsified her report..So TBW's first appraiser did exactly what Oakstar Bank's appraiser did.."Falsified the appraisal report"..That is the ONLY reason Mr. Weitzel contacted my husband the following morning and stated he was sending out another appraiser..Infact Mr. Weitzel even stated to me via phone, "I bet the home comes back to a two bedroom"..It took Miss Samatha Balsamo (second appraiser by TBW) to back up our claim, that we had stated since 2007..
Well when the home came back as the truth by Miss Balsamo, Miss Barker/Oakstar Bank stated via phone this wasn't "mortgage fraud" and Mr. Weitzel stopped all contact.."Mr.Weitzel promised that he/TBW would make this right, and yet he/TBW lied as the above names/companies (excluding Miss Balsamo) did."..My husband and I are the victims, and yet Oakstar Bank nor TBW will make it right..I reported Great Commission Realty/Gilbert "Bud" Jones to the Missouri Real Estate Commission, and provided proof..The Boards decision wasn't for or against us, but basically stated we needed to seek legal help..Then when we got the final appraisal; the honest appraisal from Miss Balsamo, I contacted the MREC again, requesting they reopen the case against Great Commission Realty and sent them (MREC) Miss Balsamo's appraisal report..I received a reply from the Board, that they weren't going to reopen the case..
I contacted Miss Barker/Oakstar Bank requesting Miss Craft's "insurance provider"..She refused to tell me, and forwarded my request via e-mail to Miss Craft..Miss Craft did not reply..I have contacted the FBI, Missouri Attorney General, Missouri Real Estate Commission, Missouri District Attorney, etc. etc. in Missouri..I then contacted the Mayor of Ocala, Florida, recently BBB, Mr. Lee Farkas, Ray Bowman, Attorney General in Florida, Mr. Bill Collum, newspapers, etc. etc.etc..You name them, I have contacted them, other then Governors and the President..I even sent forwards to Oakstar Bank/Julie Barker, Miss Craft, Great Commission Realty about my findings from the FBI on "mortgage fraud" that you sir read.."No responses!!"..All we wanted was to retire in the home of our dreams..Never expecting the home to be 100% perfect, but did expect and deserved 100% truth of the home, and "we never got it from beginning to the end"..
So TBW forecloses on the home without any regard to the circumstances, as well as they had it listed with Coldwell Banker-Vanguard..The listing with honest stipulations and showing as a one bedroom..First selling price in November 2008 at $37,790's..Then reduced in January 2009 at $32,000's..Then reduced again in January 2009 at $29,900's..I recently checked on Coldwell Banker-Vanguard's website on the home again, and it doesn't show the listing anymore..So assuming the home got sold at possibly even a lower price..So not only did we not get the home we were led to believing we purchased, but out alot of money put towards it..TBW forecloses, and puts a negative against our credit..Not to mention the physical, mental and financial my husband and I have been put through..Infact I am crying so hard right now, because I don't know how much more of this I can take..

Don & Wanda Reed, I feel for you, as it definitely sounds like you were a victim of fraud, but the TBW underwriter who responded at first never mentioned you were at fault here. They just said you are pointing the finger at the wrong person. TBW simply purchased the loan from Oakstar Bank, and obviously when it was purchased they didn't do as good of a job on quality control as they should have otherwise this problem would have been revealed shortly after it was purchased (or perhaps even before it was purchased), but to say that TBW had anything to do with the original appraisal is absurd, the appraisal and transaction was completed long before TBW saw any documentation on your situation. Oakstar Bank sounds like they either had a correspondent line set up and used contract underwriting, then when they funded it it was delivered to TBW, or TBW might have just purchased the servicing rights to your loan (most likely it was the former though). TBW has an agreement where approved brokers can fund loans, and as long as it is made under TBW's underwriting guidelines, TBW will purchase the loan without re-underwriting the loan. If you don't understand this concept then you really need to understand it as it'll help you understand where things went wrong (IMO that started with using a real estate agent who had varying definitions of what a bedroom is).
Now I can't comment on what the Fraud Manager at TBW did, from what you wrote it sounds like he didn't take as much time on this as was required, although I'm not sure that is the case since he hasn't responded to this yet (if you want him to you might want to email media relations at TBW the link to this complaint), eventually they did send an competent appraiser out to the home who determined it wasn't as originally appraised... but if what you say is correct, I can tell you that you should be aiming your frustration on the people that screwed you from the very beginning - Oakstar Bank/Julie Barker, Miss Craft, & Great Commission Realty/Gilbert 'Bud' Jones.
You even got it right before in one of your last complaints, which you posted at http://www.ripoffreport.com/reports/0/388/RipOff0388996.htm. You posted something that you either found on the FBI's website, or was emailed to you from them, etc... it is clear that you are a victim of appraisal fraud.
The steps that I would take if I were you would be:
1. Complain to the appraisal board in Missouri (website is http://pr.mo.gov/appraisers.asp)
2. Complain to the Missouri State Attorney General (although without an abundance of complains AG's usually do not do anything)
3. File a formal complaint with your local FBI office (http://www.fbi.gov/contact/fo/central.htm - appears one in KC & another in St Louis)
However before you do any of that you need to make sure you STAY ON TARGET. Some of your information in your post is all over the place, it's linear for the most part, but there is extra comments you make that are just not needed (and if you are asking for help, will be a complete turn off to the person you are asking). Remember you are asking for help, you are not entitled to receive help. I am not writing this to make you feel bad or anything, so if you take it that way I didn't mean it to come off like that, I am just trying to help you channel your frustration in the right direction so you can help:
1. Make sure this doesn't happen again to others
2. Possibly get reimbursed (would definitely not be from TBW though, it'd be from Oakstar Bank or Great Commission Realty, as I doubt the appraiser is rolling in riches).
3. See the responsible parties get what they deserve

Craft) appraiser".."It took many letters to TBW since 2007 to finally receive a reply..Then it was Craig Robeson Weitzel from TBW!"..TBW as well should have represented us with honesty, but none of the above names/companies mentioned did..What you don't understand is TBW/Craig Weitzel's scheme "backfired" on him and his first bogus (Cynthia Speckman) appraiser..Neither expected to get caught for falsifing an appraisal report, by copying off of the original appraisers false report..So where does this put us at fault?..We didn't falsify, the listing document; the loan document, the original appraisal document, as well as the false appraisal by Cynthia Speckman that TBW/Craig Weitzel hired.."We didn't purchase this home "as is/where is"..Yes we purchased this home "sight unseen" BUT we had what we believed we honest people working for us..Looking out for our best interest..Once the "sell contract" was sold to TBW that applied to them as well..I remember when Mr. Weitzel stated to me on the phone in the beginning of our conversations, asking "why would you purchase a home sight unseen"..Then he tried to state that "we" committed "fraud" because we didn't move into it..First of all, the former owner had tenants in the home..So once they moved out in October of 2007; that is when in November 2007 "we" were able to view the inside of the home for the very first time; beings we lived in Arizona and the home is in Missouri.."Once we walked into the home is when immediately we realized we had been scammed bigtime!!!!!!!!!!!".."I have been on top of this since November 2007"..Craig Weitzel in another conversation tried to blame Oakstar Bank by claiming "they (Oakstar Bank) frauded them (TBW) as well..Now I could ask Craig Weitzel/TBW, "why would you purchase a sell contract on a home "sight unseen?"..Then during another conversation with Mr. Weitzel, he basically just suggested we move into the home and keep up the payments.."I had to shake my head a few times to let that sink in?".."Now you talk about an "idiot"..I told Mr. Weitzel, "you get us the home we purchased; at least 2 bedroom, built in 1954, with good floors, and at the same selling price "we will move into it"..For a moment he was lost for words..TBW should have made it right for us, as Craig Weitzel "promised" after the second and ONLY HONEST appraisal was done..Samatha Balsamo, hired by TBW.."She did a complete, honest and professional appraisal, and the results/report proved beyond a doubt "our" claim"..If TBW wasn't part of this mortgage fraud conspiracy, "why would Craig Weitzel ask my husband on the phone and I quote: "What do you feel your damages should be?"..He also stated if the home came back as a one bedroom, etc.(which it did) he would get together with Oakstar Bank and "rectify this matter for us".."Does that sound like someone (TBW) not being responsible as well as the above mentioned for "mortgage fraud?"..TBW should have went after Oakstar Bank if they (TBW) are people of their word and so honest..Conduct business honestly..So do you still want to claim this is "our" fault?..No I am sure you don't..I appreciate your loyalty to TBW, "but you haven't walked in our shoes"..You didn't lose your job, and on disability because of all the mental, physical and financial problems incurred upon us because "others decided the "almighty dollar" superceded, the truth, honesty, intregity and dignity..You wasn't the one that in 2008 was hospitalized twice in one month for having heart problems..Then in June of that year was hospitalized for attempting suicide..You aren't the one that instead of TBW rectifing this matter as Mr. Weitzel stated they would..Instead the home got foreclosed and our credit ruined..Not to mention our entire savings (over $13,000's) for the down payment was "literally stolen from us".."Is this still our fault?".."ABSOLUTELY NOT..WE ARE THE VICTIMS..PLAIN AND SIMPLE!"..So if you still want to claim or insinuate "we are idiots" you are entitled to your opinion; as wrong as you are..I have emailed a couple of times now to Mr. Lee Farkas, Ray Bowman, KMckenzie and a few more, and yet have "never received a reply"..Does that sound like being responsible, when not even the founder/chairman (Lee Farkas) of TBW will reply to my e-mails, much less rectify this matter as promised by one of his own (Craig Weitzel) employees, and then give Mr. Weitzel his "walking papers"..One of my e-mails I received awhile back was from a former employee..I know his real name and phone number, but I gave him my word I would not reveal this information..Since "we" are people of our word I am compling with his wishes..This person stated and I quote.."'Companies like TBW, CITI, Indymac, Lehman and others knew exactly what they were doing. Farkas and Bowman and all of the other management are rolling in the millions of dollars their companies make praying on regular people like us. Then, when we try to make it right, they simply turn things over to their high priced attorneys that we can't compete with. I really feel for you. When I was at TBW, I actually fixed several "bad" deals and made alot of people happy. I guess that's why Farkas decided to fire me"..Anymore this isn't about the money that was stolen from us..It is about the above mentioned..Since they "all" chose, willfully and knowingly to committ "mortgage fraud" (not expecting to get caught) and yet have chosen not to take responsibility for their "OWN" irresponsible actions of "mortgage fraud" against "us"..Then "we" will make sure one way or another "they all be held accountable, as they should".."All we wanted was our dream home, to retire in".."Not asking for the home to be 100% perfect, but we deserved and was entitled to the "complete truth" and "we" "NEVER" got it starting with Great Commission Realty/Gilbert "Bud" Jones and ending with TBW/Craig Robeson Weitzel.."Are we still at fault?"..Again, thank you for your input, but if it takes my "last breath" I will continue fighting for the long over-due justice my husband and myself so much deserve, and so what happened to us, "won't happen to another!!!"..Thank You Again & Take Care..

Let's start with... WOW...
I cannot believe someone can be this naive about what a wholesale lender is and does. TBW does not use fraud to make money as if so, TBW would not make any money at all. As a wholesale lender, if something goes wrong, in this case, Oakstar Bank along with their appraiser scamming you, TBW takes the complete loss. TBW had to foreclose on this property and now received nothing for it. Why would TBW do this? Let's make some sense here.
Cynthia Speckman, the appraiser you mentioned, was hired by TBW to make sure the property was legitimate. Obviously, she failed to do her job properly as she simply copied the original report. TBW does not hire appraisers to back up false information. Again, who got burned in this besides you as a consumer? TBW did. Appraisers can be lazy and instead of actually doing her job, she decided to trust the other appraiser's report and simply copy. She is at fault for this and may have to answer to it. TBW would not tell her to do this as what would TBW gain?
I like how you think TBW is the one who has to correct the issue. They just purchased the loan from Oakstar Bank and ended up with crap. What are they now supposed to do to correct this? Give you your money back when you are just to blame for allowing Oakstar Bank and their false appraiser to scam you? How is it TBW's fault that they bought a fraudulent file from Oakstar, tried to investigate it, got another poor appraisal from someone they thought would do their job, and then have to foreclose on the property since they didn't receive any money from the consumer? If you are to sue someone or get angry at someone, how about you take the real criminals to court which are Oakstar and their associates.
I actually currently work for TBW, and as I am not a spokesperson for them or anything like that, I know that as an underwriter who approves and denies loans on a daily basis that I have to deny many files a month for fraudulent documentation in the file. It is our duty and responsibility to catch fraud and stop it at its source before we end up funding or purchasing the file. Every fraud file that slips through our fingers causes us THOUSANDS of dollars in losses that our company cannot get back. This process, over and over, is what causes a company to fold. As SEVERAL of the other mortgage companies did, TBW did not have a very large Sub-prime department. Our Alt-A program, while it did offer stated documentation, was very strict in trying to avoid poor quality files. Everything TBW has done was to prevent what has happened in the market today. Why would a company participate in fraud when they are the ones that are victims to it every day.
The brokers out there doing business and taking consumer's applications are not the brightest group. Some are, but many are not, (no offense to a broker who may read this) and we have to deal with the documentation they try to get through to us daily. Once the loan closes, they get their check, their "prize," then they disappear. Three months down the road when we realize, let's say, that we forgot to get a second month's bank statement, we come back to them for help. "Hey, we need December's bank statement to have a complete file as it was missed. I'm sorry for the inconvenience, can you help us?" They usually never respond. Why would they? They already have their money. After so many times that a broker either sends us bad information or does not help, we have to cut them off from sending more loans to us. This is with every wholesale lender. You get taken advantage of enough, you pull the plug.
There is no doubt, as you said, that you were a victim of mortgage fraud. What is shocking is how far off you are as to who the entity is that screwed you over. I have read the reviews of TBW online. I do understand many people have complaints. Heck, I'm have an investment condo and TBW has the second mortgage on it, and I have fallen behind and have tried everything to reach someone about getting it resolved and have been unsuccessful as well. The customer service department is doing everything they can to get better...they know this. But what doesn't get posted is all the good things the company does as well. Who is going to take the time to find one of these blogs and write something good. No one. The people who write are those who are frustrated and are looking for others who are the same.
Trust me when I say that I feel for you, but you have to be smarter about how you go about these things. I get it, he gave you his word he would get to the bottom of it, or even fix it. But when someone realizes that there really isn't anything they can do, what do you do next? He must have realized that you and TBW had been taken for a ride and both would have to suffer a loss. Yes, BOTH, would have to suffer the loss. You cannot make someone fix something who didn't originate your loan. They were given a garden hose and told to put out a forest fire. You can start spraying a few sections, but pretty soon you realize there really isn't a point as the damage has been done.
I understand you can back up your claim, as you say, and if so, go for it. You do deserve some justice. Oakstar and their associates do need to rot in jail for this as if they've done it to you, they've done it to others, and they'll do it again. Like I said, you will not believe the fraud we have stopped and continue to strive to stop. TBW makes NOTHING from fraud. Brokers do...as stated above, they've already gotten their check as soon as you close the loan.
Here is my advice. Never, ever trust a mortgage broker. Question EVERYTHING and EVERY form you EVER sign as people are out there to get you. You can keep posting things like this, but instead of yelling about it on a website. Take Oakstar and their associates to court. Call the FBI as they are the ones who deal with mortgage fraud in America and the ones who punish those who commit it. Take TBW to court if you desire, but know that there was nothing they could have done and there was no reason for them to "hire" an appraiser to say the home was okay to live in as if the property is truly bad, they lose all their money. They are going to automatically assume you and the broker had something to do with it as many times it is the borrowers themselves who are providing false documentation to get in a home.
In whatever happens, I hope it does come out right in the end. You'll never be able to salvage the money (well, maybe in court if Oakstar even has any money by now), and your credit score did get tainted, but even time will fix that and you'll be that much wiser to the crap that people will try to pull to make money.

I am taking my stance solely on what I've read based on what you wrote, and from working there by what they tell us and what we are required to do, and that is to stop mortgage fraud and approve clean, solid files, as we lose as a company if we do not stop it or approve bad loans.
