I have banked with TD Bank for 1 year now and have been paying more fees for their mistakes than I can count. I got charged over draft fees of $35.00 for an over draft of $5.00. A check from a fraudulent company (Money Plus Saver) was sent to TD Bank for $89.00 and TD Bank paid them the $89.00 without question. The check was not signed by me, wasn't authorized by me nor was it endorsed. When I noticed this debit I called the bank immediately. TD Bank supposedly closed that account & canceled my debit card so this company couldn't get any more money from my account. They set up a new account over the phone but the old account was still active. As a result of the new account and the old account both being active, the Department of Taxation levied my account because I owe them money. Because I only get social security, I contacted the Department of Taxation and the levy was released. TD Bank charged me $125 to file the levy, which is only paper work or done on a computer and to top it off my account is over drawn so I also got charged a $35.00 over draft fee. So I'm out $160 for no reason. I didn't ask them to open another account for me but they advised me it was best so Money Plus Saver couldn't go in to get more money, which isn't there in the first place. I called TD Bank's levy department and tried to get them to give back the $125.00 but they refused because my old account was levied before and they credited the $125.00 back, which in my opinion was only right since it's against the law for people on social security to have their account levied. Why should I have to pay $125.00 for simple paper work or something they enter in a computer? I spoke to a representative and also her supervisor and they both refused to credit my account with the $125.00. I'm disabled and on social security disability and I certainly can't afford to have any money taken from me. They were supposed to be crediting my account back the $89.00 for over a week now but haven't yet claiming their fax machine hasn't worked all week. As a result of all these extra charges, $125.00 fee for the levy, $89.00 from a fraudulent company and $35.00 over draft fee I'm out $195.00. I don't understand this and I sincerely pray that something is done about TD Bank's practices. They shouldn't have cashed a check sent to them from Money Plus Saver that #1 had the wrong address for me on it, #2 I didn't sign it, #3 it wasn't endorsed #4 I didn't authorize the payment. How can a bank get a check from some company  & cash it if I didn't sign he check and the address they have under my name is not my address nor was the address in the same state I live in. I live in the Bronx, NY, the check has a Pennsylvania address on it as my address. They never checked that or questioned the check. They just went ahead and sent the company $89.00 from my account and now almost 2 weeks later I still don't have my money back. TD Bank is horrible and I am closing my account(s) and never banking with them ever again. I really would like to sue them for their practices and would love to know how I can go about doing this so they can't keep doing this to anyone else. Since the check wasn't signed by me or anyone else they shouldn't have cashed it. They should have noticed the address on the check wasn't my address and another reason the check should have been questioned. The check wasn't signed and that's the final reason they shouldn't have cashed it. I guess the check was an electronic check but for all the reason I just stated the check should never have been honored or debited from my account and now I'm over drawn and broke.

One big problem with the advice that Ted gave you. If you open an account in someone else's name you're going to have trouble getting your direct deposits accepted into the account. If your name is not listed as an owner of the account the bank is forbidden by federal law to accept deposits in your name. There are many reports on this site by a wife or husband who had their joint tax refund sent to an account with just one of the names on it and the return was legitimately returned to IRS. This same rule goes for all deposits (including checks) into the account.  Also you won't be able to get checks or a debit card in your name.

Additionally if your friend has another account with the same bank that goes into the negative, the bank can legally take money out of this account to cover the other.

As far as avoiding the levies I would suggest going to court and proving to the judge that the only income you get is from Social Security. That should stop the approval of the levies because the bank will not always refund the levy fee to you.

And I used to work customer service at a bank so I know what I'm talking about.

And they will make you fight to get your money back. I had a tax lien put on my account with Wells Fargo which was a mistake. The bank charged a $100 fee also. The State refunded the money once they realized it was a mistake and the bank reversed all OD/NSF fees that resulted but not the $100.

I asked them why they did not refund the $100 fee since it was a mistake by the state and not me and they said they would refund it if the state faxes a letter admitting it was a mistake. Well obviously if they refunded what they took out it was a mistake but I had the state fax them the info..a few times. They did finally return it but it took 3 months and calling them and the state at least twice a week.

Just look at the way the bank treats it's customers if they make a mistake but they can just wrongly charge and keep a fee for months without justification. Don't get me wrong I am satisfied I did eventually get made whole again but it should not have been such a fight for me and go on for so long. If anything they should have fought with the state and refunded that fee as soon as the state faxed them what they asked for admitting the lien was in error.

Thanks again Ted. I too had to respond to that person who wrote those rude comments. But obviously they didn't know what they were talking about especially when they stated other banks will do the same thing. I have dealt with other banks and had the same thing happen. When I had a dispute at other banks my money was credited back immediately and then they investigated. I didn't have to wait for weeks. I also had a levy put on my other bank acct. that was credited back and the charges were credited as well. I don't understand TD Bank's policies but they are the only bank I have used that has given me so many problems. I also see a few other people that have filed complaints against them too. The fact that they cashed a check that wasn't mine, didn't have my address on it and wasn't signed or endorsed threw me off. The bank never checked the address on file for me. I don't care if it was done electronically, my address was no where near my physical address. Before they cashed it I should have been notified. I banked with Chase & The Dime, when they were still around. Any time there was a questionable check or transaction they notified me to make sure the transaction was legitimate. Thank you Ted for your comment to that rude, heartless idiot who responded to my post about TD Bank. You were right, he's/she's an idiot and rude. I appreciate your advise about opening another account in someone else's name because that's what I'm going to do. TD Bank realized they were wrong and have reimbursed all my money and removed all the extra charges and fees.

But because this has happened to me a few other times with TD Bank, I will be closing  those account and opening a new account with another bank. If you'll notice I wrote "those" accounts because they opened a new account for me but never closed the old account, which defeated the purpose of opening a new account. I just wanted to thank you for your comment and response to the idiot on my behalf.

In response to Flynrider- Phoenix: You are sadlly misinformed and shouldn't make comments on things you have no clue about. For your information I fought TD Bank & got all my money back because they were wrong. I was also able to get the levy released and got the fee the bank charged me for processing the levy back also. So before you make comments on things you should first know what you're talking about because you were wrong on every account in this case. I also agree with Ted who responded to your comment. You are rude and heartless. Your comments were that of an immature person with no banking knowledge at all. I hope I never hear from you again because I hate dealing with ignorant people and you're at the top of the ignorant list.

Your rebuttal to the consumer compliant is so heartless and Rude! You think you know it all don't you! I have news for you  the consumer is 100% correct despite what you may think!!!

If they do go after him for that he can stop it first know this they have to have a judgement against you and a court order to take any funds out of your bank account and by law they have to notify you first before any funds are taken out of your account!

Note: You can also open up a bank account in someone elses name that you trust and that will stop them from any judgement that may have against you!

In regards please don't be an ignorant rotten piece of garbage that you are acting like!!!

   Their mistakes?    When you overdraft your account (by $5 or $500) that's YOUR mistake.

  That is also your mistake.  You are responsible for legal costs regarding a levy on your bank account.    You can't blame the bank because they opened the new account so you wouldn't continue to be defrauded by the fake check people.  That is standard practice at any bank.   The fee you ended up paying is a direct byproduct of being a deadbeat taxpayer.

  Is that just wishful thinking?    Have you ever heard of Check21?  Do you know what an electronic check is?   Just out of curiosity, how did this Money Plus Saver organization get your name and bank account details?

  I have no doubt that they will be overjoyed at your decision.  Sadly for you, nothing that you described in this post would have happened any differently at any other bank.

  By the way, don't be surprised if the taxman goes after your new account and your new bank.  I suppose that won't be your fault either, right?
