On June 21, 2004 I called Team Ford in Tucker and was told to come in and see what they could do for me. I explained to the person I spoke with that I was trying to trade my car in because I commute to and from work over 100 miles a day and needed to get out of my current car because of the mileage.

I arrived at Team Ford husband and kids in tow. We were there from 2:00 p.m. to 8:00 p.m. They told me it would be impossible to trade my car in because it wasn't worth as much as I owed and I would be too upside down and it would cause me to have payments I could not afford if I applied it to my new loan. They told nme that if I kept my current car they could put me in a car. I did decide to keep my car because my son had just graduated from school and needed a car for work and college.

I talked to my son and explained he would have to make the payments. Which he has a pretty decent job for an eighteen year old and I knew he could handle a $300.00 payment a month. This would free me up from making that car note and I still had two years left to pay on it. My husband has a 1997 Montero which will be paid for in October of 2005 and his payment on that is only $280.00 a month.

I understand if my credit was really bad which my beacon score is 626 so it's not that bad except for who knows how many times they ran my credit through. I test drove a used ford Escape and a new one. I liked the used one, but they told me the bank would not finance a new one becuase of the risk of breaking down that I could get into a new one with less mileage. I decided on the 2005 Ford Escape and I have had it a week today. I got a phone call tonight stating they want the car back that the fiancing fell through because I have three cars in my name if I get this one and I cannot carry three cars on my credit report.

I have had this car a whole week and now they want it back. I just do not understand how they can make me go through all that paper work and now I have to give it back. I filled out all the forms and even got how much my payment would be and everything. I spent six hours in that place and they let me drive off the lot and I wasn't even approved. How stupid could one be. That would be like giving someone $20,000 dollars in cash and calling them a week later and saying oops I need it back. Get for real they ripped me off. I even put extra money down and they better give it back.

Team Ford sucks and I will definitely spread the bad news, because I have a big mouth and that can be your worst enemy. I really am planning on protesting outside where everyone can see me that they are a rip off.

Thanks AmieinChandler,Arizona for the compliment. Laura I am going so put some light on your situation. Trust me when I get done, your car dealer will hate me more then they hate you for posting a Rip Off Report.

Laura I can say that I know for a fact that www.ripoffreport.com gets about 7,000,000 hits a day. Just think how many people will get to read your Rip Off Report.

You said that "They told me that if I kept my current car they could put me in a car." That's a BIG HEADS UP in my eyes! Many car dealers in this country like to send FALSE and FRAUDULENT credit applications to banks so they can get car loans approved much faster.

Banks in most cases like to see to it that a car buyer can truly afford a what they are buying. They want to know that you make enough money to pay your current bills and the new car payment.

Many banks also like to make sure that you are NOT going over a safe budget. Too many car dealers do NOT care about you or your budget. Profit for them is MUCH MORE important.

Now I want you to go to the following Rip Off Report and take a close look at the second picture. It is a picture of a car Buyer's credit application. From what I was told, The car dealer altered it before they sent it to an auto lender.

Mis Bass had no Idea what had happened until I had a chat with her. I took all of the Pictures in this below Rip Off Report. I know what pain car buyers are feeling after a dirty car dealer has taken them to the cleaners.

Now I want you to contact your auto lender after you make about three payments on your car. I want you to ask your auto lender to send you a copy of the credit application that they got from your car dealer. YOU my Fellow American might get a BIG FAT SURPRISE!

Car dealers are willing to go to any length to increase their profit. There is a fast growing trend of car dealers lying to banks by padding the buyers income, leading the cosigners to be believe they are in fact the cosigner but they have the cosigners sign first.

Car dealers want the banks to fund deals so bad they are willing to send all kinds of false info to banks. Problems like car dealers deceptive ways can be stopped by the banks questioning the buyer BEFORE funding any deal.


If you find that there is some FALSE INFO or a SIGNATURE that is NOT YOURS, you have BANKING FRAUD! If you find what I say has happened to you, make sure that your state banking commissioner gets a clear copy of your COMPLETE RIP OFF REPORT! Maybe they might find others that might have what I mentioned.

Fax a copy of your Rip Off Report to the following fax number. Trust me your car dealer will not like me at all when I am done.

Now I feel that it is time I provide you with some VERY informative reading. This is what I call PROOF that car dealers get laws passed that will help them RIP you OFF.

Laura read this below real good. I hope what I am posting will help you.

Let's say that you bought a car from your so called friendly car dealer and soon after your purchase you find you been Ripped OFF!

So you think you can take a car dealer to court and get your case in front of an honest jury, RIGHT! Think again and real hard then read the below what I found on the net. Print this off and save it if you do not fully understand it have someone you trust read it then explain it to you.

Now read this below real good.

"June 7, 2000Chairman Gekas and Members of the Subcommittee, Public Citizen is submitting this testimony because we believe that the use of mandatory pre-dispute arbitration clauses presents a grave problem for consumer rights and public safety.

The use of mandatory pre-dispute arbitration clauses is growing at an alarming rate and congressional action is urgently needed. If the trend continues, soon we will have a private justice system adjudicating disputes that is largely controlled by corporations.

Automobile Consumer Credit Fraud

On January 31, 1999, Ann Brown of Sandusky, Ohio borrowed $5,500 at 25% interest from a J.D. Byrider Franchise car lot to finance her purchase of a car from Byrider's used car lot.

The car turned out to be a "junker" and a safety hazard. The entire wheel and axle fell off when Ms. Brown's teenage daughter was driving down the road.

In her lawsuit in Ohio court, Ms. Brown alleged that she was forced to pay an artificially inflated price in violation of the Truth in Lending Act.

Ms. Brown also alleged that Byrider violated the Truth in Lending Act by requiring her to accept an $895 warranty fee that was also to be financed by J.D. Byrider at 25% interest. In addition, Ms. Brown alleged violations of the Ohio Sales Practices Act and fraud.

But Ms. Brown was denied her day in court by the district court in Ohio, which ruled that the arbitration agreement contained in Ms. Brown's contract had to be enforced because of the FAA's policy favoring arbitration.

Under that arbitration clause, Ms. Brown LOST ALL her claims under state and federal lending and consumer protection laws although Byrider retained the right to sue her.

She also waived her right to punitive damages, no matter how reckless or malicious Byrider's conduct. Instead, she must proceed under Byrider's choice of arbitration, for which she must pay half the costs and attorney fees.

The costs of arbitration, which begin with $300 - $500 filing fees and approximately $1,500 per day arbitrator's fee, exceed the value of her claim. It is simply not worth it to take the case to arbitration.

In sum, Byrider is using this arbitration clause to insulate itself from the consequences of violating the Truth in Lending Act, Ohio Sales Practices Act and flat-out fraud.

Ms. Brown did not understand that she was waiving her right to go to court when she signed an arbitration agreement with Byrider.

This is hardly surprising because the Byrider financing officer himself had no idea what arbitration is or what the rules of arbitration are, so he was unable to tell Ms. Brown what rights she was waiving.

Nor was she given an option -- the credit contract was presented in a standard form, take-it-or-leave-it format and she was not allowed to challenge any of its provisions.

The mandatory arbitration provision only applied to Ms. Brown. Had she defaulted on her loan, Byrider would have been able to file a lawsuit against her.

When Ms. Brown first filed her lawsuit, Byrider stopped using the mandatory arbitration clauses in their contracts. But once the courts refused to vindicate Ms. Brown's rights in court in favor of arbitration, Byrider began using the clauses again.

Ms. Brown's attorneys have received inquiries from over 40 consumers similarly defrauded by Byrider. Unfortunately, no matter how many of J.D. Byrider's former customers are defrauded, they cannot file as a class action because the mandatory arbitration clauses in their contracts waive their right to maintain class actions.

Don't EVER think that car dealers hire lawyers to write up car buying contracts that help protect consumers from auto dealer deception.

If your so called friendly car dealer wants you to sign a contract that has a built-in mandatory arbitration clause in their contract, tell them to SHOVE IT!

Laura you might like to use the contact info that I posted for you. We at one time had an advocate in New York that loved to do what I am now doing. He is no longer able to help car buyers because of his health. I guess it is my turn to help car buyer expose the car dealers dirty games.

I am sorry what happened to you Laura. I totally and completely know how you feel. Kind of like being bent over and not having any lube. The SAME thing happend to my husband and I not just once TWICE!

Do a search on Tempe Dodge. Our story is on that thread. I have also come across more than one person that this has happened to. Be careful that they do not pull you back into the dealership and want you to give them more money down, or a higher payment or higher interest or a different car or ALL the above.

It happens and it happens alot. Search for some of the post a guy named Stick puts on here they can maybe be of some help. He seems well versed in the shady deals carlots pull. He has plenty of good info.

Next time you go to a dealership look it up on here first and see what kind of people you will be doing business with. My story does have a happy ending though. We went to a Toyota dealership and got a brand new Corrolla with a fraction of the interest rate that Tempe Dodge wanted to charge, a decent affordable payment, and no money down.

They were great. We now have had the car for 3 months and had no problems with the Toyota dealership. It sucks you have be so suspicious but in the end the research will pay off. Good Luck!
