BEWARE OF TESORO APARTMENTS OF PHOENIX ARIZONA, DO NOT MOVE IN HERE

I spoke with a Jennifer Williams, regional manager,  on 2/29/12 about some problems I am having with my old apartment complex. I was previously living at Tesoro Apartments for about 12 months, my lease was set to expire on the 28th of February. Unfortunately some things had happened and I was given an immediate termination notice on the 10th of February, the reason being "misuse of a gun" even though no charges were filed and there was no weapon on the premises.

I received a letter from the apartment complex including an invoice of the "move-out" charges which totaled $588.54, I understand the carpet replacement and the repair of the floor; however, April, the office manager, had added on a "Pet Fee" for $300.00 which is absolutely ridiculous, I have never had a dog or a cat or a hamster or a gerbil or a bird or any sort of animal. I spoke with April at the Tesoro office, she said that there was cat food and urine stains in the carpet.

THAT IS PREPOSTEROUS!

I have never even had an animal in my apartment! I politely asked her if there was anything she had to prove the findings of  "urine in the carpet" and she said very rudely that she has all the documentation she needs and that she will not allow me to see the apartment nor the evidence that she has of me having a pet. I asked her politely again if she could show the stains in the carpet and she very rudely again stated that she has everything she needs to prove that I had a pet and that doesn't have to let me see the apartment or the pictures or proof of the urine. I did not try to argue with her because she was already being extremely rude so I said, "At this point, not only have you taken my home from me, you are trying to take all my money as well?" She says, "You shot a gun in your apartment!"

I said, "No, I did not."  I began to leave and I said to April that I will not pay for the pet fee. She said, "That's fine we'll send you to collections and they will garnish your wages." I say to her, "Good Luck with that." She says again, "If you have a job they'll garnish your wages and if you don't have a job well that's your problem."

I continue to say Good luck to every comment she makes and as I open the door to leave she calls me a B*tch. At this point I wish I had never come in contact with Tesoro Apartments, I wish I could reverse the whole last year of my life and not move into Tesoro Apartments.  All I want is to just move on with this. I refuse to pay the pet fee. I never had a pet and for her to add that on after I moved out, for her to fabricate these statements is ridiculous.

The Saturday after the termination notice was given to me I turned in my keys to the girl that works on weekends, I'm unsure of her name but I know that she has the skin disorder that causes one to lose pigment, I asked her for the police report number and she gave me a number that started with a 000029. I called into the Phoenix police station and they said they have no record of that number and that when a police report is filed the date is in the number and it doesn't begin with zeroes.

They have now sent me to a collection agency and they're trying to add interest to the amount. This isn't a credit card! Not only is the amount over $500.00 but now that's adding 10% interest per annum COMPOUNDED DAILY!  I will be taking them to court. I do not know of the date that I will be doing this, seeing as I must save up the money for the court fees, but I will not allow this wretched excuse for an apartment community get away with committing an act against my civil rights. They are committing Retaliation!

On a side note, I went to speak to the carpet company that they use to clean their carpets, (supposedly they have been using them for the past 18 years so who knows what sort of deals they could be conjuring up) and I asked them how they test for urine. They use a black light which shows urine of ALL TYPES, there is no difference between human urine and dog urine, they are both urea and will both show with a black light. I asked for a written statement that says that black light will show human and dog urine and that the carpet company has no solid method of differing the two, the woman in charge said that she couldnt do that because it would hurt the business relationship they had with Tesoro Apartments.  Why would it hurt their relationship, unless they were up to something?

I believe that Tesoro Apartments planted the urine and is trying to ruin my life and my credit. BEWARE OF TESORO APARTMENTS OF PHOENIX ARIZONA, DO NOT MOVE IN HERE

  As I guessed, you have a basic misunderstanding of civil rights.    Retaliation in a landlord tenant dispute (which is what you claim this is), has no connection to civil rights.   BTW, your interpretation of "retaliation" is not the same as the legal interpretation.  

   You can file whatever you want with the AG, but I can assure you, they're not going to touch this.   It's a civil dispute, not a civil rights dispute.

  Given your story, the only leg you have to stand on is a small claims dispute on the bogus pet deposit.

When filing a complaint with the Attorney General in the state of Arizona, it is under the Civil Rights division, you then check off retaliation.

Retaliation is defined in the Landlord and Tenants Act as: include increased rent, eviction, or reduction of services to you within six (6) months of your actions.

The story must be described in order to understand where the charges are coming from, the "misuse of a gun" is merely a precursor. The act of retaliation by Tesoro Apartments in the form of a pet fee is the issue at hand.

You seemed to be dancing around the issue.   Would it be safe to say that someone shot a hole through the floor of your apartment?     If so, no surprise that they would want you to move.

  It's $51 to file in Maricopa County.  You can recover the fee if you win.

  Now I'm disappointed.    Why is it that everyone who strongly invokes their civil rights immediately proves that they have no idea what civil rights actually are.   Here's a hint : Do not mention your civil rights when you go to court.  You won't help your case.

  Committing retaliation?   Is that supposed to mean something?    I strongly suggest that you limit your complaint to the pet fee and nothing else.  Do that and you may stand a chance in court.
